Can her children come later on a K-1?

Hi everybody!

It been a while since my last visit here. A lot has changed and I have to resubmit my petition. What has changed is I found out she has 2 children. (I know, some say I should run) I have accepted this because I love her and now the girls also. I understand that they could come here with her at the time she comes over to the US. (ages 10 and 17) My question is: Can I bring one daughter over a year from now? And the other at a later date? This is how she wants it. Any advice will be appreciated.

Yes they can follow to join but at the interview you will need to notify CO of this :yes:

I believe theres a one year time frame from visa issue but i can be wrong...

Wait a sec, she told you at the last moment she has 2 children?. That's really bad. i would have trust issues with this woman. If she waited this long to tell you is because she did not want to scare you away and no you dont know this woman as well as you may thing, hiding 2 children is a big deal it sounds very shady . I might be wrong but things may change direction once her children are in the US and if she happens to move out and applies for welfare the IRS will go after your taxes . It is up to you though . Filipino women are notorious for these type of things.

Actually she told me she was not ready to marry at the last moment. The rest i found out later. Trust me, you're not the first to warn me. That almost ended us but I have forgiven her. I already told her that her ex can't come here! LOL

The father of the children needs to authorize them to leave the country with the intent to reside in the US (or anywhere else, for that matter). I moved your post to the regional forum for better guidance.

This is not good news however because he would say no even though he won't care for them. Does this apply even though there is no marriage or one in the past?

Thanks so much for your reply. I'm hoping that it is the mothers decision. This is a touchy situation but i want to know where we stand. I'm pretty sure Hank has helped me out before so maybe he can chime in.

When you fill out the 129f you list both children. The child left behind has one year to have her interview and to follow. The other child will attend the interview that Mom has. I don't know the reasoning behind the decision for one and not the other but it's a lot easier to have all three come at the same time. Just my 2 centavos.

The father of the children, if he has abandon them and is not supporting them, then the mother has sole custody and can leave with the children via immigration. That is a Federal Law in The Philippines.

Put on your Nike's and run. How long have you two been in a "relationship?" Do you really want to marry a woman that slips in at the last minute that she has 2 kids? Pretend you are talking to a friend and they tell you this scenario. What would you say? You have to wonder what else she is hiding.
