So my rfe says

SUBMIT EVIDENCE FROM THE BENEFICARY,XXX 'XXX ,THAT HE PLANS TO MARRY WITHIN 90 DAYS OF HIS ADMISSION TO THE USA.EVIDENCE OF THE BENEFICIARY'S INTENT MAY BE Q STATEMMENT,WEDDING PREPARATIONS OR OTGER EVIDENCE TGAT CLEARLY ESTABLISH HIS INTEND TO MARRY.

I have told you about this letter. Now, as far as I know, you need the ORIGINAL letter that he/she signed. They do not take the copy of the letter. As far as I know...

It took us 3 weeks exactly to get our case number from NVC and that was with me calling.

We just finished filling out the DS-160 form. Holy moley that was intense. 3 hours. We are having it looked over and double checked and then submitting it online tomorrow. Once submitted the consulate in Sydney will contact us with an interview date! :) So hopefully sometime next week we could know our interview date.

Question about the i-134 affidavit of support.

What evidence do we need to provide if you are over the 100% poverty limit & even 125% over?

Do we really need to send 3 years of tax forms?

Pls help

Current pay stubs or letter of employment? I would check with other filers at your embassy in the regional forums and see what your country really looks at at the interview.

Yeah, I've been hearing it depends on embassy. I'm sending last year's tax transcripts, and a letter of employment with my salary (i just asked my HR for one and told them what to put on it) and my most recent pay stub.

Yea they will accept it. That is what I did. Try to make it look like the original though.

Hey sorry for your Rfe. The good thing is they at least touched your case. So I do agree with the letter of intent...a scan would be good too. But I'd recommend to add also screenshots of you guys chats where you talk about the marriage wedoing plans and things like that...to support the letter.

Question about the i-134 affidavit of support.

im going all out

im giving my fiance wage/income transcripts , w2 , pay stubs , bank statements , tax returns , letter of employment

the tax returns/w2s /transcripts will be 2015,2014,2013

2015 will be the most recent tax return if your interviewing before march/april 2017

most likely they wont need the previous years but im just gna give it to her just incase

Just got off the phone with NVC. No case number yet. The guy tried to tell me I have to wait 6 weeks for the USCIS to forward it on to NVC. Then 2 more weeks for them to process and get a case number!

Yeah sorry im not waiting 2 more months before I call again!! It's been 1 week since NOLA2 i will call next week at the two week mark and every other day after that! As i know that time table is bull !!! But he did say it will go straight through to embassy.

He also kept trying to tell me my uscis # had 1 too many digits. I kept saying sorry thats what i have!!!

The 6 weeks line is their default statement. You can call every day, and you should :) It's just them covering their butts and saying they have 6 weeks before you can launch an official inquiry. I got my case # within 3 weeks, and that seems to be the case for most people here.

It is recommended you send an original. I believe we actually sent a scan with our petition, but now that you're in RFE stage they may be more nitpicky.

Have your fiance/e 2-day post a letter, it shouldn't be too expensive?

This was a response I read in another thread asking if you are over the 125%:

I already have my letter from my employer and tax returns gathered.

The letter from employer and recent tax return will suffice even. Bank letter not required, so you should be fine.

The I-134 instructions are vague and don't really apply to a visa with immigrant intent. Since the K-1 is processed through the immigrant visa units of the consulates, they tend to go by the I-864 guidelines, even when using the I-134. This is also because you will need the I-864 not long after obtaining the K-1, after you are married and filing for AOS. Check your consulate's instructions. If they do not ask for a bank letter/statements specifically, then they are not required. They are usually used for someone that is self-employed, someone using assets, or someone that needs to prove non-taxable income.

You can read through the whole section on public charge in the FAM, but here is an excerpt on the use of the I-134 geared towards a K-1 applicant>

(3) Use of Form I-134:

(e) To substantiate the information regarding income and resources, the sponsor should attach to the affidavit a copy of the latest Federal income tax return filed prior to the signing of the Form I-134, including all supporting schedules. If you determine that the tax return and/or additional evidence in the file do not establish the sponsor's financial ability to carry out the commitment toward the immigrant for what might be an indefinite period of time, or there is a specific reason (other than the passage of time) to question the veracity of the income stated on the Form I-134 or the accompanying document(s), you should request additional evidence (i.e., statement from an employer showing the sponsor's salary and the length and permanency of employment, recent pay statements, or other financial data).

Most consulates ask for them. See the excerpt from the FAM above. Your consulate might not insist, but their instructions state they are preferable. It is ok if your most recent taxes were filed with your ex. Show the 1040 and your W-2 to show your individual income from the joint return.

Documentation regarding financial support can be in any form – preferably one year of tax returns, W-2s, bank statements, earning statements, letters from employers. PRESENTING ONLY THE AFFIDAVIT OF SUPPORT I-134 FORM IS NOT SUFFICIENT. The I-864 form is not required for a fiancé(e) visa.
