Hey guys!

My husband and I are in the process of applying for a Greencard for him based on marriage. He was a student here on an M-1 visa, we got married May 1st and got our receipt May 9th.

Two weeks ago we got an Request for Initial Evidence asking for our joint sponsor (using a joint sponsor, my father, to meet the income requirements) to submit an I-864A (along with a couple other things). Which from what I understand is a form between the sponsor and household member whose income he is using to help support.

However, he is not doing so and did not make any mark on his form that he would be doing so. So, we don't understand why we would need to fill this out.

We set up an Infopass meeting about the RFE but the person we spoke with there was absolutely no help. Can someone help shed some light on this situation please?

Did your father fill i864 as a joint sponsor? Does he file tax return jointly with your mom? Sometime they may ask i864a from your mom. If you copy and paste the exact wording of the RFE (without personal details), it will be easy to understand what they are actually asking for.

My father did fill out an I-864 as our joint sponsor. He does file jointly with my step-mom, but she doesn't make any income. So, he's not claiming that he's using her income to meet the requirements. He makes well over the amount needed.

Here's what the RFE says:

"The joint sponsor indicates on Form I-864, Affadavit of Support, that qualifying household member(s) income will be used for the joint sponsors income to meet 125% of the poverty guideline. The joint sponsor failed to submit one or more Form(s) I-864A, contract between sponsor and household member, for the household member(s) whose income is being used to meet the poverty guideline.

Submit a completed Form I-864A for each qualifying household member whose income is being used to meet the poverty guideline."
