Hi Folks,

My husband and I are currently in the process of filling out forms for submission of the AOS. I came on a K1 visa and we married more than a month ago.

In the I-864 Affidavit of Support, which should we check? I am getting confused if it should be A or D although my Husband is above the 125% poverty level.

a. I am the petitioner. I filed or am filing for the immigration of my relative.

b. I filed an alien worker petition on behalf...

c. I have an ownership interest of at least 5 percent in...

d. I am the only joint sponsor.

e. I am the first, second of 2 joint sponsors.

f. The original petitioner is deceased. I am the substitute sponsor.

I believe it should be "a"..thats what we put anyway.

Feb 10, 09 - I-751 sent to CSC

Feb 12, 09 - NOA1

Apr 20, 09 - Approved!

Jun 12, 09 - Card Production Ordered

Jun 19, 09 - 10 year GC Received

D doesn't apply to your husband - a joint sponsor is someone who is not the petitioner.

Just a note. I did not complete section seven where you list assets if you fall below poverty guidelines. I was RFE'd for it even though I am well above the guidelines. I resubmitted my application and wrote not required in section seven and it was accepted.

From what i have always understood about USCIS forms they don't want you to leave any sections blank .. they want N/A or NONE in those spots so that they know you didn't miss it by accident .. This could be the reason for the RFE ( stupid reason! but since when do they need a good one )

I agree with you. It was a stupid error on my part. However, the instructions for the form clearly state that if you meet the poverty guidelines it need not be filled out. Live and learn.

I know about the N/A and did that in all my forms except for the I-864, I just now recall not having put N/A or Not Required on it and I was approved. I wouldn't try and do that though, it's always best to cover all your corners.
