Hello

Can someone please help me

I just got a question to ask..

anyway here's my situation.

I am a filipino and a US Citizen, and ive studied here in the philippines for 5 years. so basically i've overstayed for 5 years already. i wasn't really suppose to stay and study here but i decided to do so anyway. my question would be, how much do you think i would be paying for over staying. i got here in the philippines May 17, 2011. i was just wondering that are my options? could i apply for a duel citizenship? if so how long would it take to do so and what are the requirements? hope you guys could help me..


P.S i was born here in the philippines and migrated to the US at the age of 15 (which i was already a blue passport holder at the time) because my father was naturalized US citizen while my mother was a filipino citizen at the time

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Got your Philippines passport? Just show that one when you leave, no fine for staying in the country of your citizenship.

If you don't have a Philippines passport, go get one, problem solved.

Was a recent thread dealing with the same situation, this was the consensus reached.

Yeah. If you have not applied for/gotten your dual citizenship, go do that. Like I said, there was a recent post on this same topic, BI is where you need to start the process to get your dual citizenship.

Hey I studied in the Philippines as a USC. Was it hard to get a student visa? Wouldn't the overstaying fees be more expensive than just applying for student visa?

If you get you Philippine Passport before you leave, even if you entered not yet being a dual citizen, they will give you a PP on your passport and you will not be charged anything. If you got a student visa, then you would also not be charged for those months you had a valid student visa as I understand it.

anyway, how long do you think it would take to get a dual citizenship?

because i was thinking of paying off the overstaying fee if it takes too long, would you happen to know how much the fee would be?

just to clear things out. i need to get a phil passport and apply for dual citizenship and thats when ill be able to go back to the u.s without any problem.

so you mean i just need a philippine passport and present both of my passport when leaving the phil and present the us when i get to the us? is that it? or i need phil. passport and apply for dual citizenship?

If you get you Philippine Passport before you leave, even if you entered not yet being a dual citizen, they will give you a PP on your passport and you will not be charged anything. If you got a student visa, then you would also not be charged for those months you had a valid student visa as I understand it.

yes thank you, i think its 3-5 months.

even though i can provide all the requirements to get a phil. passport. i still cant apply for it, is that it?

You could certainly try, but the way I understand it, you must have your dual citizenship first.

I'm no expert, but depending on if/when your mother applied for dual citizenship, there is a chance you may have acquired it from her. Something to look into.

Did you have a Philippines passport when you moved out of the Philippines at 15 yo? Might just be a case of renewing it.

If you were born in the Philippines and your parents did a CRBA and got you a US passport back then, then in theory you should be ok just getting your Philippines passport to be able to exit without a huge fine.

I'm curious though, how did your parents get you out of the Philippines at 15 yo without paying a massive overstay at that time? Have the rules/fees changed since that then?

my father (pinoy) was in the U.S at the time he petitioned the 4 of us, including my mother who was still a filipino citizen by then and when i migrated to the u.s i was 15 while my lil bro was 10, we both had a blue passport but my older sister and my mom got a green passport at the time. i dont really know how it works back then. but it took awhile before my father got us.
