Hi, Folks,

My wife just got her US student visa (F1) recently to attend an intensive English program. The school registration ends on Aug. 20th, 2016. But due to some family and work reasons, my wife can not arrive at the school before Aug. 20th. The school official said she will have to be delayed to the Jan. 2017 for admission since she will miss the registration for classes.

Since we have booked our flights on Aug. 25th. We want to know if she can apply for a B2 tourist Visa in August to use this airline ticket for a short-term visit and return to US in Jan. for the delayed admission. How likely will she obtain a B2 tourist visa if she just got a F1 Visa in July for attending a school in August?

(I am her husband and currently living in Canada with permanent resident status. I have a full-time job in Canada. I am sponsoring my wife for immigration to Canada, but during the immigration process, she is not eligible for a non-immigration visiting visa to Canada due to so-called immigration intention. That is why I am sending her to US to learn some English. )

Please advise. Thanks.

Where is she from? How is her international travel history? What will she show as intent to return to to her home country after her visit to the US?

Based on such information, experienced members might give you their opinion of her chances. Most likely they are slim, and no one can know for sure unless she actually tries.

If it isn't difficult, it isn't worth it.

Her chances are slim (and even getting a tourist visa interview appointment before your travel date may be difficult), but if you have the money, no harm in trying.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

She can definitely try for a visitor visa but as said, chances are very slim. The fact that she is trying to to US on a visitor visa at this time after her class got delayed by one semester might just create a doubt on the CO's mind that she is just trying to be in the US at any cost which would probably result in visa denial.

Applying for a tourist visa may make it look like she is desperate to get to the US and could affect her F-1 if is viewed that she is trying to circumvent US immigration laws because her start date has moved.

The rule is not to book flights without a visa in hand. You violated one of the big no-no when waiting for a visa.
