AP in Ukraine

The closer we get, the more intense it becomes. I am flying to my girl for a couple of weeks on Friday.

The worst thing is some sort of indefinite AP and then letting the K-1 die.

Does Kiev ever do that?

I have the CR-1, leave of absence, and go to Ukraine contingency if they refuse it.

But AP is like in limbo. Does Kiev let applications with red flags that they do not like just die after a long AP.

Kiev isn't known to be a tough embassy. Have you read the Reviews (link atop every VJ page) for clues?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You are probably over worrying and experiencing anxiety. There have been plenty of folks with similar situations that have been approved. Think positive and Good Luck!

I was looking at the timeline summary where a lot stop after the interview. Tonight I looked deeper. A lot of those interviews were approved but the member did not enter a visa received date so it looks like the petition died at the interview even when the member subsequently enters AOS information. I would love to be able to add the approved column to the table.

AP in Ukraine particularly means it takes longer time for them to review your case.

K1 will not "die" if it was approved and sent to NVC.

If anything your visa/case will be denied during interview if there are strong red flags.

Have your medical done btw (I've had experience with false flag TB which resulted in 90 days waiting for sputum test results).

also what does it mean you're flying there in couple of weeks? not very smart in the middle of k1 process since you might be denied because of immigration intent, especially if you answer that she's your gf or fiance

Oh, what a day, what a lovely day!

He said he is leaving on Friday for a few weeks. What's not smart about it? It's only natural to want to see your fiancé.

Even I am leaving for Ukraine this week for a 5 week visit to see my fiancé (plus our wedding. there).

Some more stats from the database: lowest time from file to interview was 52 days in 2006 and again in 2008 There was one 55 days in 2014. 2015 had one at 63 days and quite a few at less than 90 days. I'm at 41 days and counting.

What is the largest age difference that has made it through Kiev without problems? She is exactly half my age at 31.

The most accurate timeline will be those within the past year.

I know how you are feeling. Went through this K-1 process in 2004 and back then it took about 5-6 months.

The largest age difference I've heard of through Kiev was 26 years.

Regardless, if K-1 doesn't pan out for you, there is the option of doing a CR-1.

So you can understand my concern. My Ukrainian friends who know me are not surprised even though they say it is unusual.

I'll be ready to get married on the same trip if the deny the K1. Will they issue a B2 if I start the CR-1?

Yes. I am getting my divorce decree apostilled as I type. I have a first rate translator advising me.

1) seek your last divorce judgment and make it apostilled with the Department of State.
2) scan your passport first page and send to us
3) birth certificate is not needed
4) a single status affidavit with apostille is also needed

Item 3 is cool because I was a US Citizen born in Germany to US military parents. My birth certificate is in German.

I know it's crazy. If she already had a B2 she could visit the USA while CR-1 is in process. If she doesn't have a B-2, and you start the CR-1 process, they won't issue a B2. I can tell you that ordinarily a B2 is difficult to get in Ukraine, especially for young women.

Yeah, we already tried. What would be the grounds for denying the K1? I don't think they can say I am too old. That would be age discrimination,

That is why I worry about AP limbo.

I don't see your K-1 being in limbo. It takes time to go through the process. Unfortunately, it always seems to take longer than we want. The only grounds I could see for denial is if they don't believe it's a bonafide relationship and that would be determined by the Consular Officer, not at NVC.
