Hi,
I am a Dutch citizen married to a US citizen and was granted conditional permanent residency on 7/22/14. On 6/09/16 USCIS received our I-751 to remove the conditions along with a I-912 request for fee waiver. I had already been in contact with USCIS as I had not heard anything the day my card expired (7/22/16). Finally today (7/30) I get the whole package returned, with my I-912 being denied because of no proof of 2016 income ( we had only included 2014 and 2015 tax returns).

On the form/letter on top of the return package it says to resubmit i-751 within the required filing period, but it is no longer within that 90 day window as my green card has now expired. I am probably over-stressing, but I just want to make sure that we don't make any more mistakes. Can we resubmit i-751, along with the other letters and an explanation showing it's late because I am only getting this all returned. I did set up an infopass appointment but it is not until 8/12.

Also, should I send everything back before that appointment or wait until the appointment? I mostly just want to see if I can get an extension stamp in my passport so that I have proof that I am in the US legally.

Ok, thank you. Do I just sent back the original forms they already took notes on? Or do I print new forms? And I guess I take out the 912 denial letter or do I send that one back as well?

Also, I have an info pass appointment set up now, should I go to just clarify everything and potentially get my passport stamped?

Yes, send it all back with the proper fee enclosed. Include a cover letter for why it's coming late.

I would follow millimelo's advice, send everything back, with a check for the proper fee. Be sure to make a copy of everything you sent back, marks and all.

Do the Infopass to get your passport stamped. Be sure to bring your copy of what you just sent back, for viewing by the local IO.
