I have confirmed with my laywers and a few others. Yes, even though documenr check list does not say that. You still have to do it by providing as much evidence as you can. I thought I did not have to produce more evidence after 751. You can just submit it without evidence at your own risk when all the legal counsels and lawyers all say you have to based on their experience. Is it worth a risk? Go ahead, do it without and see what happens. I would not do it. It makes sense that you have to do it because you are allowed to apply earlier based on marriage.

Directly from USCIS' check list: 

If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items:
1. □ Evidence that your spouse has been a U.S. citizen for the last 3 years:
a. Birth certificate (if your spouse never lost citizenship since birth); or
b. Certificate of Naturalization; or
c. Certificate of Citizenship; or
d. The inside of the front cover and signature page of your spouse’s current U.S. passport; or
e. Form FS-240, Report of Birth Abroad of a Citizen of the United States of America; and
2.□ Your current marriage certificate; and
3.□Proof of termination of all prior marriages of your spouse (divorce decree(s), annulment(s), or death certificate(s)); and
4.□ Documents referring to you and your spouse:
a. Tax returns, bank accounts, leases, mortgages, or birth certificates of children; or
b. Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past 3 years; or
c. An IRS tax return transcript for the last 3 years.

If you look at the check list, it is still very similar to 751 evidence except it does not say photos and trips, there is a reason why lawyers all say you still need to submit the same kind of evidence because it is still very similar to what 751 requires unless you think all lawyers are bad and full of ,lol

It says OR. Therefore, if you go with item listed in 4c, you are more than fine (of course, also providing the other items I previously listed). 

 

My lawyer, and other friends who have successfully applied for citizenship in the past based on the same exact conditions (marriage) also concur. 

 

That said, nothing wrong with loading the application, but by all means, absolutely not required by USCIS aside from the documents presented in the Documents Checklist.

I think lawyers want people to apply as if they are still providing evidence just to be on the safe side. I just quoted the check list, lease, bank account and tax returns are still very similar to what 751 requires. "Absolutely not required" is silly and a bit dangerous. There is no "absolute" in the immigration process especially you are using marriage to apply 400 early. Like I said, why run the risk? I would not, and I am not the one who makes up the general practice as to what to submit. I do not understand why you have to be so strict about it when most lawyers would say otherwise. Do It at your own risk. You may get a RFE for 400, who knows? i would not take a chance, I have been collecting as much evidence as i can, and I gave all of it to her, she can sort it out which one to file next week. I would not worry about other applicants as every adjudicator might be a bit different. Good luck.

CSC now is severely backed up. I have heard that it is is very possible they may just combine the 400 and 751. You got your NOA in November, so it is going to be a very very long while for you, and it seems indefinite as well for people like me who filed last July or August. i filed mine last August 4, NOA for 751 is August 8, 2016. So given the nature of the extreme backed up, and the possibility of USCIC combining 400/751. It is more of a reason to treat the evidence required by 400 as if you are still applying for 751 because if they do combine it, it will show the on going marriage is strong in my opinion. Well, good luck, god knows when CSC will start touching even July filers. I am focusing on 400 to distract myself from indefinite nature of 751 unprecedentedly long and extreme delayed processing.

Yup, I'll do the same on November 1st, not holding my breath on getting a ROC approval prior to that. 

 

Either way, I'm doing a considerable amount of travel in the meantime, so at least, time does fly for me.

My lawyer told me she had never filed 400 while 751 was pending for her clients before. This is very unprecedented. Vermont Service Center has not slowed down at all. It usually takes them about a year to process or a bit over a year. CSC used to be like 9 to 10 months, I wish we could find out what triggered this unprecedented delay for CSC. They have not even started touching the July filers yet. Maybe the flood gate will be opened all of a sudden, one can only hope but i would not count on that possibility. My guess is they may start approving July filers by October.

I happened to check my facebook page, i posted on Visa Journey this January talking about CSC being so jammed up. CSC was on last mid May this January, wow, and now they are on June 15th last year 7 months later. So it took 7 months just to move 1 month? So it will take a whole year to move 2 months worth of applications, then they won't approve any of the July filers until next Feb, and they will start touching August filers next August,lol. Wow, one more year, and VSC will be way ahead of us by next summer. That is why i was liked "  Fxxk IT", and decide to file 400 when I am eligible which is tomorrow actually, but my lawyer told me to wait for a few days to avoid USCIS' because sometimes they can be confused themselves and falsely think you file too early even though you use their USCIS early filing calculator, so we will file a week from today, they want to combine the both and adjudicate it both, fine by me,,,this is crazy.

You're right - technically it's only the list of documents requested, but I thought it was pretty light. They don't ask for much and given how important the application is and how we can all apply sooner due to marriage, I thought I'd back it up. I've seen a lot of other people do it here. I basically included bills from every quarter, car titles, car registration, car insurance, and copies of all of our travel from the past 3-4 years. The travel was honestly what made it heavy af. :lol: I didn't send any pictures.

The entire packet, sent priority, with confirmation, etc. was still only $12.00.

OK!  Since they have my relationship documents from my I-751 application, I'll include a couple of new documents.  :whistle:

 

We've recently bought a condo so I'll attach a 1-page document showing our condo ownership.  I'll also include the latest bank statement (1 page).   That should be more than enough since I'm including my marriage certificate and 2014, 2015, and 2016 tax transcripts.  :yes:

I won't overload my N-400 with the same relationship documents either since USCIS has already determined that your relationship is legit and removed your Green Card conditions on most N-400 applications.  :)

 

Unless... they're still processing your I-751 application.   But...if so, they still have your relationship documents so you don't need to overload them with the same documents.  :D

Never had any issue, either with my husband or by myself. I have heard that lately, some people have been sent to secondary; that's most certainly a nuisance, however, unless you have a tight connecting flight, it is hardly an issue and will not cause any problems if all else is the way it should be. So by any means, do enjoy Canada!

I won't overload my N-400 with the same relationship documents either since USCIS has already determined that your relationship is legit and removed your Green Card conditions on most N-400 applications.  :)

 

Unless... they're still processing your I-751 application.   But...if so, they still have your relationship documents so you don't need to overload them with the same documents.  :D

Seriously - don't bother with Express. I sent on 7/22, it arrived next business day 7/24, payment processed 7/26 (but took forever to clear?), and still no NOA/confirmation despite the e-confirmation form. :(
