Did anyone else not file tax transcripts with their package? I was unable to log back into my account where I requested transcripts two years ago, the system didn't let me set up a new account, the snail mail transcripts never got to us (we had moved during this time) and I couldn't reach anyone by phone. So I just sent our return and W2s and decided that I'll visit a IRS physical office to get the transcripts if USCIS sends us a RFE. Still a little nervous though, especially since we only have 2015, as we had no income in 2014 and I didn't think you could file a return if you didn't have income. Fortunately our other evidence is solid.

The same thing happened to me, I couldn't log back on IRS website, they changed the process. USCIS wants the original transcript from IRS, so I had to order for the hard copy to be mailed to me, it took 7 days to get it from IRS, it is way better than just sending my 1-751 with Turbotax printed out paperwork and getting RFE. I had RFE based on W2's and tax return during my adjustment of status and it took close to a year to hear from USCIS, I cant deal with that stuff anymore.

did you include it in your cover letter, that you didn't get the original IRS tax transcript in the mail yet?

Assembling the I-751 Package: Checklist faqs.gif

Forms and Documents (follow these assembly instructions. All supporting documents must be in English or be translated as noted here.):

1. Payment as required by USCIS. Use a personal check so you can track the payment. Money Orders are also accepted. Read the Guide to Paying USCIS Immigration Fees. 2. Cover Sheet (example here) 3. Form I-751, Petition to Remove the Conditions on Residence (see example form) 4. Copy of the Green Card (Front and Back) for the person filing to remove conditions (and any K2 children) 5. Evidence of Bona fide Relationship (see below)

Examples of documents showing a bona fide relationship (Submit COPIES only. Do not send originals):

1. A deed, showing co-ownership of your property or a lease agreement with both of your names on the

lease. 2. Utility bills, credit card bills, and other types of bills which have both of your names on them. Since many utilities will only put a bill in one person's name, some bills in one name and other bills at the same address but in the other spouse's name serve the same purpose: showing your financial & social lives intermingled. 3. Copies of actual credit cards, health insurance cards, or other "joint" cards that you have together,

showing same account number. 4. Car, health, or life insurance that has both of your names on the policy or the other spouse listed as the

beneficiary. 5. 401K or other retirement plan with spouse listed as beneficiary (right to survivorship is the technical term) 6. Bank or stock accounts with both of your names on them. 7. A copy of your joint federal and state tax returns (including W-2's and other applicable Schedules and attachments). Sending an official tax transcript from the IRS (for Federal) is beneficial and often preferred as it reflects what was actually filed. 8. A car title or other titles to property showing joint ownership with your spouse. 9. Birth certificate of any children that have been born to your marriage. 10. Documentation of any vacations that you have taken, including flight itineraries, hotel bills, pictures of you

together on vacation. 11. Other family pictures of you together. 12. Documentary proof showing evidence of your children together (Copy of Birth Certificate, photos, etc) 13. Copies of Christmas cards and other holiday cards addressed to you both

I made a mention of the 2014/no income situation in our cover letter. I didn't not mention not receiving the transcripts at all. I should have.

When I have a chance, I will pay the IRS an in-person visit. Aside from wanting the transcripts, we never received our refund check and the online system (again) won't let me check on our status. We just haven't had time to get there yet as the nearest office isn't close to us and we both work full time.

My Green Card expires end of November 2016. The 90-day window before GC expiration starts by the end of this month. Received a letter from DHS on Aug 8 reminding to file the I-751. It's interesting to see them not address me as FNU. Thanks to them, I am mostly addressed as FNU by those who don't know me. The letter mentions that if sufficient evidence is submitted, the interview might be waived. I am a student, going back to college for two more semesters. I have never missed a day of school/college ever. I plan to submit my petition at the beginning of November so that by the time they do decide to schedule an interview, I would be done with college. Would that be a right thing to do or is it wise to file immediately once the 90-day period starts?

2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.
5/16/2014: Congressman's immigration caseworker contacted supervisor at NSC who said the petition is pending and will be dispatched in two weeks.
5/27/2014: Petitioner received response from NSCFollowup that the case was pending an internal extended review. Really?
6/19/2014: USCIS case status change, "On June 19, 2014, we shipped this case..."
7/1/2014: Case received at NVC.
7/14/2014: NVC case number assigned.
8/1/2014: AOS and IV fees invoiced.
8/2/2014: AOS and IV fees paid.

We wanted to file earlier in our window as we want to bring his elderly dad over to visit and we worry our time is running low as far as him being healthy enough to make the long trip. We figured we might have better luck if husband is an unconditional vs conditional GC holder. Otherwise, we were also eager to get this step started so we didn't have to worry about it anymore. But I wouldn't think US Tree Killing Service would give you a timeframe and then punish you for filing at the later part. I wouldn't advise anyone to file super last minute (as mail can get delayed) but I don't see any problem either 3-4 weeks out.

You can file anytime in the 90 day window. I waited to make sure I took my time to get everything compiled and copied. When I was satisfied, I mailed it.

I m going to submit my papers tomorrow, my Green Card will expire in October. I have everything ready except for the confusing I-751 form where I am debating Should I leave all the non applicable space as blank or should I write "n/a" physically on the form. But the complete form will look messy with all the n/a, also I am worried if they will key in as n/a for any of those questions. Please advice!
