My husband just turned 89, I could not find the info about what happens if he dies while my 751 is pending, that possibility has always been my fear and concern, but that's the reality, I need to face it and be prepared if that happens both mentally and legally, So I decided to bravely face the reality and ask my lawyer what happens if he passes while my 751 is pending. Not saying it is going to happen, but he is 89 even though his health is not bad, but sometimes you never know. It just makes me angry about the whole situation and process because it wasn't really our fault that we could not get married until 2013. Oh well, anyway, fingers crossed too, in a few days we will find out how slow or how fast they have moved since 4/18, my prediction is like they have moved forward for about a week worth of applications, so slow, we shall see. Fingers crossed. I hope we all get approved before August so we don't have to make an info pass appointment. Fingers crossed.

According to https://www.uscis.gov/i-751, I see the following sentence in the instructions (page 6 of 10):

 

"If you are filing as an individual due to the death of your spouse, submit a copy of the death certificate with your petition, along with evidence of the qualifying relationship."

 

So you'll need to send them a copy of the death certificate since you've already sent them evidence of the qualifying relationship.  You probably don't have to worry about it since your hubby is a healthy 89-year-old gentleman.  :star:

Thanks for doing the research for me. I am just wondering that too if that happens. But the question is whether I need to resubmit as a widow or refile the whole application or just submit the death certificate adding to the evidence I have already submitted. Just need to know and be prepared if that happens. But I should not worry prematurely like this since my husband is in pretty ok health. Thanks, 9 months and 9 days of waiting and still counting... Finger crossed for all of us.

You were right, my lawyer told me if that were to happen, all I would need to do is to notify USCIS and submit the death certificate and my case would still be under pending until being approved since I have submitted more than enough evidence. The chances of that happening are very low, but good to know.

The update of the processing times is looming. Fingers crossed. I hope we will see some significant movement when the update is available. At least moving 2 more weeks from last month, but i would not count on that..

VSC should see some significant movement, but I don't think CSC will see more than a week.

Updates are up. Looks like CSC didn't move, but Vsc is on the first week of April as of March 31st. Atleast 3 months to go. Anyone know when well be safe from RFES?
