In case these I751 cases have even longer processing times, you can file your N400 3 months before the three year anniversary of his green card. For you, that looks like you could apply in the July/August time frame. If our I751's haven't been processed by then it also forces them to adjudicate on them in order to process the N400 which *could* speed things up.

Yes, I have heard that, but my lawyer doesn't seem to think that is a good idea. She thinks I should get approved first. She said I would not be eligible until I get my 751 approved. Technically it is correct i guess because if I apply this early August while 751 is pending, that means that won't process it until they get my 10 year green card, so I don't know if that actually would force them to expedite it or not. I have heard N400 is also very backed up, it might take a year now. Anyway, I will ask my lawyer again when the time is close and if I still have not gotten the approval. Hopefully I will get approved before August, and if i do, that will have taken a whole year to get them to process my 751. We will see. Thanks for the response.

I am little worried about my situation, my conditional green card expired in October 2016 last year, and i filed form i-759 in August of 2016. I did the bio-metrics on time and received the notice letter, and also received the 1 year extension letter that would expire in October of 2017 this year.

My question is several people have discussed about getting a stamp on their passport within a month from the expiry of their 1 year extension letter which extends their status for another year. My situation is i don't have a passport and i applied for the advance parole document for travel and that has also expired in 2016.

If i do no receive the permanent green card, i will still apply for the naturalization in July 2017 ( it will be 2 years and 9 months) but even the naturalization process is backed up, so my question is

Will i be out of status once my extension letter expires in Oct of this year ?

and will i have to do the whole green card process again? thank you in advance to anyone who can contribute to this.

1. Are you saying you don't have any passport at all (we're not talking about a US Passport - the stamp goes in your home country passport).

  • You won't be able to leave the country without a passport - the Green Card (GC) allows you to return to the US, but won't admit you to any other country.
  • You won't ever need an Advance Parole (AP) Document again. That allowed for travel before you got your GC, but the GC itself provides the same benefit.
  • If your home country passport is expired or lost you'll need to get a new one. 
  • That said, though, I've heard of people getting the stamp on some other piece of paper to prove permanent residency (although it won't help for travel)

 

2. You can apply for naturalization 90 days before the anniversary of your green card expiring (basically the same rule that applied to your I-751), whether or not your I-751 has been approved. Some people say it speeds up decision on the I-751, some say it slows it down, but you can have those two petitions running at the same time.

 

3. No, you are never out of status unless your application is denied. When your letter expires in October, if you haven't gotten the stamp, you are still a Permanent Resident, you just have no documentation to prove it. The likelihood for most people is that they'll never need that "proof," but when you do need it, you want it right away, so it's best to get the stamp and be secure.

Yeah, lots of reasons - we lost a lot of income in January because of all the snow... at least 10 days income since we depend on people being able to get out and about to come to lessons. Also, housing prices are going up, to the point that we can't really afford to buy the kind of place we need, and since there are no rent controls here, we could easily get priced out of renting a big enough place to teach out of as well. Plus, to be honest, we're both from parts of our countries where there's just a lot more sunshine, and after 10 years in the Northwest, we want to get the <BLEEP> out of the rain!

We're thinking AZ... sunshine, heat, snow only on the mountains, and good real estate prices. Plus, we have a bunch of family down there... even my dad does the "snowbird" thing there in the winter! 

And yes, I only just discovered that myself, about having to be in the state for 3 months before you apply. It won't be too bad, but it is a drag. It's because every application is actually processed in the applicant's "district." Just hoping AZ keeps processing at about the speed they are so I'll still get citizenship in time to vote in the midterm elections... turn AZ a little more purple!

Exactly, it just takes time and money if you don't have the money to hire a lawyer. But we have come thus far, we are almost there...good luck.

Yes, me too, I would love to cast my first vote next year, if I am able to apply for 400 with my 10 year green card this August, I should be able to vote as it will be over a year for them to process 400 before next November.

Maybe you can apply for US citizenship in Aug if you're still living in Oregon; then, move to Arizona in Sept?  :idea:   Oh, I hope I can vote in 2018!  :dance:

A few people in the threads have told horror stories of USCIS "losing" their N-400 applications when they moved to another jurisdiction. So I'll just wait and apply once I've already got settled. AZ seems to be processing N-400s in less than a year so I should (knock on wood) still be good to vote in 2018.

 

Yeah, Portland is in a serious housing crunch - prices are skyrocketing! I don't know much about the job situation (since we're self-employed) but teaching music lessons is a pretty portable business model - unfortunately as self-employed people, we need a less competitive housing market so that a mortgage broker will actually look at our pre-tax as well as post-tax numbers!

 

My plan is to welcome all the people in the winter and then go visit THEM in the summer!

I have a feeling that houses are much cheaper in Arizona than in Portland, OR.  :)   But... I heard that houses were not that cheap in Scottsdale (where my in-laws lived)?  :blink:  Frontier Airlines sells super cheap discount tickets from Seattle/Portland to Phoenix!  :idea:   www.flyfrontier.com

I have a feeling that houses are much cheaper in Arizona than in Portland, OR.  :)   But... I heard that houses were not that cheap in Scottsdale (where my in-laws lived)?  :blink:  Frontier Airlines sells super cheap discount tickets from Seattle/Portland to Phoenix!  :idea:   www.flyfrontier.com

Don't want to jinx it, but yes, right now there's a huge disparity in prices.

We prefer Southwest (2 checked bags for free!) and their tix are cheap too! But if this is you guys asking to come visit us sometime when you can't stand the rain anymore, just let us know! We'd love to hang out!
