Sent application to Lewisville, TX on 07/03/2017. Case received and check cashed on 07/11/2017. Biometrics: 08/03/2017. In Line for Interview: 09/05/2017. Interview scheduled: 09/18/17 (notice received 09/21/17). Interview date: 10/23/2017. Oath date: 11/02/2017. Passport received: 11/20/2017.

Hello,

 

My husband is traveling to Australia and is worried about not being allowed back into the country. In 2013 he was denied entry into the US due to him overstaying his ESTA by 14 days. That triggered this whole processes for one year until he asked me to marry him and then the process of applying for his visa began. 

He received approval for his green card in September 2014 and came back to the US in October 2014. 

 

We know the I797C says that it serves as a one year extension of his conditional residency, but my husband is still nervous that they may give him a hard time because of the 2013 denial of entry. We have left the country before and have still been let back in, but is GC was not expired yet. 

 

Any guidance or reassurance would be a relief!

I have just come back home (San Francisco) today from Colombia / Mexico using the one year extension letter and no problem at all. The CBP officer (a young woman) was very kind and nice. She asked me to go to the secondary room to have my data checked in the USCIS system because she wasn't able to do that in her computer. So, after fingerprinting me I went there and they checked all my information right away. It took five minutes. They stamped my passport and customs form with the ARC (Alien Reigstration Card) stamp. Easy and neat

I read today that as of November, CSC is processing May 14, 2016, so we are no longer at a 6 month wait.  I guess the discussion of a 8-10 month wait is true.

Does anyone know what to do when you lose your extension letter?

September 25th: I-130 Emergency petition filed at US Embassy in Lima.

October 3rd: I-130 Petition Approved.

October 10th: Consular Section sent checklist and notification scheduling my spouse's visa interview for November 13th.

Not sure... but best guess would be to make an appointment at USCIS to get the I-551 stamp in your passport. They usually don't do it prior to one month before your extension letter expires, but if you've lost your letter they might do it... or they might be able to get you another copy of the letter.

Does anyone know if you can go to the local office and make an appointment in person? The online thing only gives times for the next two weeks, and of course there are no available appointments.

Just a hypothesis here, but it just occurred to me so I did a minute'sresearch online. The whole west coast has gotten hit by a kajillion winter storms this year, including torrential rains, landslides and flooding in and around Laguna Niguel, where the California service center is. Could this be why approvals of (as far as USCIS is concerned) low priority petitions like I-751s have slowed down so much? If so, then now that the weather seems to be stabilizing, they can all get back to work!

I don't think that has anything to do with the slow approvals from CSC. I was told by customer service that the I-751 is a low priority petition for USCIS when it comes to clearing their backlog. The reason being you are already in the US, have lawful status, are allowed to travel, work etc.  

   

I know the wait sucks but it is what it is. I think August filers should have approvals by the end of May.

Yes, I know we're considered low priority... I even mentioned it in my post! ;) But I have noticed that there doesn't seem to be much of anything coming out of CSC lately... Which made me wonder if maybe weather might be a factor. And there have been a lot of weather related landslides and flooding in that part of CA. 

So if some people have been unable to work, of course not as much gets done... Which affects us "low priority cases" even more than others. 

It doesn't really matter... We wait as long as we have to, as always. But I thought it was interesting that the traditionally speedier CSC has seriously stalled as of the beginning of 2017, and wondered if there might be a reason.

Is there anybody around here who is planning to go back to the Philippines this Month or next month? We are suppose to go home but my GC is already expired and the only paper I have is an extension letter and an I 551 stamp. Do you think I'll have a hassle coming back? Just worried that the trump ban might also affect us (yes, I'm paranoid :unsure:)
