I am a big advocate for saying that USCIS call center is useless, however....

I also called few times only to hear some complete nonsense, but last time I called I got lucky and there was an actually decent person, who took initiative to submit a service request for me (without me even asking for it) and said that I can call them everyday if I want to to check on a status of request/case.

Its just like you said, this person was just rude. Don't listen to it and call them whenever you have a need of it. You are a "customer" of USCIS and you certainly can call them anytime you want. 

With this being said, it does not mean that you will get someone responsive from the first try, nor does it mean that they will actually have any updates for you, but they certainly cannot restrict you in to not calling them for 60 days...

I had my infopass appt this morning..  I handed my documents to the officer. After about 5 minutes  he called me  again and gave me back  my passport with the stamp in it...

I asked about my case and he made a face like this <_< because he saw I've applied for N400 while I751 is pending.. I said it's been 14 months since I applied for I751, I haven't heard anything..   I was eligible for N400 and I decided to apply hoping that would make some movement . He said by applying for N400 I've only complicated my application. .

 

He said when it's the time for your N400 to be adjudicated they'll put it on hold until your I751 is adjudicated. Also when it's time to adjudicate your I751, they'll see you have a N400 pending and they won't adjudicate your case and will transfer it to the field office... 

he basically said right hand doesn't talk to the left hand and it only causes delay in your case... 

I'm so sick and tired of waiting. The officer was so negative ugh

So much for it ‘forcing’ them to adjudicate the I-751. This is USCIS...it forces them to do nothing.

I think he is trying to scare you, so if what he said is true, then when it is time to adjudicate 751, they will transfer it to the field office due to the pending 400. When it is your turn to have 400 interview, they will see 751 is pending, so they will have to adjudicate 751, which will result doing both at the field office which is what we all have speculated. Nothing unusual.

The left hand definitely doesn't talk to the right hand, but the rest of what he said isn't entirely accurate, which is fairly typical for a large chunk of USCIS staff.

It gets transferred to your local field office so that the I-751 and N-400 are adjudicated in the same place, often with a joint interview. The way he describes it it would never be approved :lol:

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

USCIS can never be forced or prompted  to do anything. It is unpredictable, especially CSC this year.

Well, it is not fair that I am balding already in my 30s. It is not fair that I don't make 300k a year. Etc. Let's not extend the concept of fairness.

 

But I will rephrase and eliminate the word "fair":

 

USCIS CSC should review I-751s strictly in the order they were received (NOA date). Period.

Submitting a concurrent N-400 should not be a reason to bring an I-751 to the front of the line.

I don't see why USCIS would act in contradiction to its rules (and, in general, if there is one rule at USCIS is that applications are processed in the order they were received, a senator call or a loophole in the process should not bring an application to the front of the line).

 

When a concurrent N-400 will be approved? Hope it gets approved for everybody as soon as I-751 approved and within the 6-7 months timeframe of submitting the N-400 as it is for everybody else.

I'm not sure why you think ROFL (Rolling on the Floor Laughing) emoji might be a sort of bullying.   You can Google it to get more info on ROFL.  I won't use emoji on this posting since you may misunderstand it again (which is not a big surprise on this forum since we're very international with different cultures and languages.)

As I said, there is no point in talking about whose applications USCIS should process first on this thread since none of us works for USCIS and determines whose applications should get processed first.  Unfortunately, USCIS often processes applications randomly.   Having said it, you're free to contact USCIS to express your concerns if you think it's not right.  Anyway, this is my last posting on this issue (and reply to your posting).  Good luck with your I-751 process!

So, (because I have all kinds of better things to do but I'm also a very talented procrastinator), I started searching for all the people on the CSC July 2016 list who seem to have been "skipped over" in the approval process. 

The most recent couple of approvals are from people with NOA dates of July 25. The people who are not showing as approved are:

  • People who filed N-400 (sorry, it doesn't look too good for those people getting a physical 10 yr GC - they'll eventually get citizenship instead)
  • 2 or 3 people who mentioned in-thread that they'd received RFEs
  • Almost all the rest are people who haven't actually been active on VJ at all for months. So it's actually reasonable to assume that some (if not all) of them have actually been approved, and they just aren't visiting the site to update us.

I actually find that quite reassuring, which is why I've shared. It seems like August approvals may finally be not too far away!

Check date on your extension letter. I think CSC only started reviewing august cases. You should hear in a month 

Yes i looked at extension letter and it says end of august as date . Hope they will start reviewing  august fillers soon at California Service Center

I wonder if it is possible for those of us who applied for 400 with 751 pending to get a 751 approval very close to the 400 interview date without necessarily being combined?? Like a week or two before the 400 interview. I guess it is possible since USCIS is so unpredictable.  However, personally, It is going to sting a little knowing I might be skipped over when others(None 400 751 filers) are being approved, especially after waiting for so long and finding out they are delaying for another 6 months, but I guess I am mentally ready for that because my focus is the 400. It is also unpredictable to know exactly when they are going to get to August..maybe next month, maybe December, I hope they are getting there soon.

Sorry to bring your hopes down, but I don't believe this scenario is possible, as both 400 and 751 using same physical file and it is only one.

I think thats why USCIS call center not recommending to apply for 400 before you got results on your 751(Although, you are edible to do so).

Also applications has priorities and 400 is higher priority than 751, therefore when you applying for 400 while 751 is pending they simply take away all necessary documents from 751 to 400.

I saw someone from VSC who is from June (or July, I don't remember) who didn't get any reply on 751 yet(VSC is currently on October/November), and not surprisingly this person did apply to 400 as soon as he got eligible...

I do not believe it is possible to "speed up" 751, if anything, applying for 400 will stop it. However, if your end goal is citizenship then there is no harm at all, you just most likely will never receive an actual green card and will be naturalized instead (and possibility of "double" interview)

Totally agreed. I was just curious about if the above mentioned scenario is possible, it is highly unlikely it will happen, even if it did, why would they go through the trouble producing the card knowing the applicant is going to surrender it it pretty soon after the 400 approval?  So I will probably never get my 10 year green card, but the 751 will be approved by law though, they have to according to INA. Yes, having applied for 400 is not going to speed up the 751, some applicants seem to think that is a possibility, and unfortunately, no one can prompt or force USCIS to move an inch of anything, on the contrary, it actually delays it and combines it with later 400 adjudication. Normally this doesn't happen because applicants usually get their 10 year green card in a year, but this year is so delayed(CSC) that it forces many applicants to apply for 400 while they are eligible while 751 is pending. Yes, my ultimate goal is 400, so I just need to wait it out and get over 751 being delayed even though like I said, it might sting a little bit being skipped over,lol. After all, I can have all the patience i need mentally, but I am only human. :unsure:
