Implying that the I-130 was not a "major application" is extremely disrespectful of the people who had to wait in another country away from their spouses for months and months in 2013/14 waiting for their I-130 to be approved... and once it was approved, that only gave us "permission to apply" for our visas, which took another several months.

But when you speak as though you have authority about parts of the immigration system that you haven't experienced and don't understand, suggesting that their experience was somehow "lesser" than yours, it undermines everything  else you say.

I went through 601 waiver application, and if I were denied, I would have been deported. Gay people weren't able to apply for immigration benefits until 2013. I have been with my spouse for 20 years and we weren't able to apply for immigration benefits until Supreme Court decision of striking down Defense of Marriage Act. The bullshit LGBT people went through can not be compared to what straight people have gone through. Before you falsely judged me, you should have thought before you accused me of being insensitive. I merely was saying 130 and 751 are quite different. I did not in any shape of forms implied 130 is less important than anything else, but it is true that 130 is an important step for spouses who live overseas. I did not have that experience, but that does not mean I think it is less important as you false accuse me off. We could not even have a chance until 2013, and I have known my spouse for freaking 20 years and my spouse is already 89 years old, and he might pass away before I even get my 751 approved. So you want to lecture me about discriminatory stuff we have gone through, or lack of experience of immigration, think again before you speak. I was merely saying 130 is different from others. You know what 601 waiver is? Do your googling, do you know what Defense of Marriage Act is? Please do your Wikipedia search. I was merely pointing out the difference, and i apologize if I offended anyone, especially Austin Canada who went through the same discriminatory bullshit we went through. What we went through is more extreme than 130, but we don't whine and get so sensitive about what other people say, but for you to accuse me of something that is not true without understanding what I was trying to say is just over the top. Think before you accuse people just randomly without something bigger, discriminatory you have never experienced before. Every one knows I am frustrated? A lot of people are, not just me. Your accusation of me is extremely false and talking about disrespectful.

Hey, AustinCanada, I have never meant by any means that your 130 experience is less like someone accused me of. I apologize if you feel that way because that wasn't my intention. A lot of people do not understand what LGBT immigrants went through. I was lucky I was in the states apply for 130, and I respect the fact that you waited for a long time.

Apology accepted. I apologize too if I offended you in any way about 130. That was not my intention. I guess I should not have said 130 is not a major application. A lot of overseas beneficiaries always wait for a long time for 130, it is a crucial step that leads to 485. I was lucky because I applied in the states and I was approved at the interview. I understand the importance of 130, and I respect the fact a lot of people's having gone through the extreme wait time.

Took a chance and talked to a second tier immigration officer. He said i might not even need the 10 year green card because they are looking into my 400. So i asked him if my 751 is being combined. He said no because they are two different processes. He said my case is even better because i might not need the 10 year green card, just wait for the 400 interview. I am not sure he knew what he was talking about because I really thought he meant that USCIS was combining my two applications into one. He said the reason there is a delay was because I applied for 400 which is not accurate because many CSC 751 applicants have not applied for 400, and they have been waiting for over a year and a few months. So maybe the officer is confused himself?? USCIS officers certainly are not on the same page all the time.

It was because of the stupid decision that USCIS made to process DACA applications over overseas spousal applications!  :cry:

According to what I read, you and your spouse have an I-751 interview; then, your spouse steps away and you have an N-400 interview on the same day.  :reading:

 

Your visa officer may not adjudicate your applications on the spot.  :no:  That was the case of the June (May?) filer I mentioned.  They had to go home without getting approved since the officer wanted to take more time to process their applications.  :wacko:

So you think the interview may or may not happen? Do you think your chances of getting the interview are big or the same as mine? Or applying for 400 while 751 is pending automatically triggers the interview for 751 no matter what? I still think there still could be a chance that we get our 751 approved first though.

Yes, we may get your 10-year Green Card before our citizenship interview.  :whistle:

 

If that happens, your field office won't conduct a combo interview and your spouse doesn't need to be interviewed.  :star:
