I-751 August 2016 Filers

@Zombie69 I believe at this point none of the August-16(CSC) applicant has been approved on the VJ thread and I think it's the case for every CSC filer. At this stage N-400 has got nothing to do with I-751 for August applicants because CSC didn't approved anyone. It would be interesting to see when CSC starts approving August-16 applicants and skip the one who filed for N-400 than we can assume that USCIS will combine both I-751 and N-400. In other case they might approve I-751 before N-400. When USCIS starts approving August filers we will get a clear picture.

I personally hope they will still approve 751 applicants who applied for 400, but so far based on June and July filing, we have not seen one being approved with 400 pending. Will that change when they get to August? I have a feeling it won't, but with the unpredictable nature of USCIS and CSC, we will have to stay put and see since none of August filers with or without 400 pending have been approved.

I'm filing online in a little bit more than a week, and I have heard of others at my local office with the same kind of timeline as yours. That would be absolutely great and I keep my fingers crossed for that.

Did you file on line or on paper? My bet is you filed on line.

Yeah, I just checked. I have heard not everyone can file on line. We have to be careful though, we are not supposed to talk about 400 here.

I filed on paper - because I couldn't find how to file online. Once I sent it out - I figured out how to file online.. Was debating if I should call fedex and cancel delivery, but didn't in the end. After all, filing by paper gave me the opportunity to send more evidence anyway.

That is right. I guess filing on paper gives you the ability to send more evidence. My evidence for 400 is very similar to 751, I guess it is good because if they do a dual adjudication, maybe the richness of the 400 evidence will increase the chances to be approved(both 400 and 751) on the spot at the field office, we shall see.

Once I-751 approved (same time as any other I-751), then shortened waiting time for N-400? I'd agree that waiting time for N-400 should not start at 0 when I-751 gets approved, but should count from the date N-400 was filed. But it shouldn't be quicker than for those who are filing N-400s alone (non-marriage n-400s, etc), otherwise it'd be unfair for the N-400 filers.

Well, we don't make up the immigration rules so there is no point in talking about what's fair and what's not.    

 

Based on my experience, the US immigration has been very unfair to me since I waited for 13 months for my I-130 and I've been waiting for 14+ months for I-751.   

 

At this point, I wish I had a "problem" of others thinking that it's not fair that my application got processed so fast!

True, whether it is fair or unfair is basically useless. There are people who filed 400 on line the same time as me already got their interview letters. It took you 13 months just to get your 130 approved, it took me less than 2 minutes at the AOS(filed from the U.S), you can always find stories that appear to be unfair, but it all comes back to USCIS' problems, inefficiency, inconsistency, and red tape unfortunately.

Well, it is not fair that I am balding already in my 30s. It is not fair that I don't make 300k a year. Etc. Let's not extend the concept of fairness.

 

But I will rephrase and eliminate the word "fair":

 

USCIS CSC should review I-751s strictly in the order they were received (NOA date). Period.

Submitting a concurrent N-400 should not be a reason to bring an I-751 to the front of the line.

I don't see why USCIS would act in contradiction to its rules (and, in general, if there is one rule at USCIS is that applications are processed in the order they were received, a senator call or a loophole in the process should not bring an application to the front of the line).

 

When a concurrent N-400 will be approved? Hope it gets approved for everybody as soon as I-751 approved and within the 6-7 months timeframe of submitting the N-400 as it is for everybody else.

There is no evidence that applying for 400 will speed up the 751 process, as a matter of fact, it is just the opposite. Applying for 400 seems to delay the 75, of all the June or July filers who have yet to be 751 approved, 100 percent of the the applicants who applied for 400 with 751 pending, none of them have been 751 approved. So I don't understand why you seem to think applying for 400 will expedite the 751 approval. It delays it until probably when the 400 interview is available, and the dual adjudication will probably take place. If we really want to talk about "fairness". There are applicants that applied 400 online this August and some of them have already gotten the 400 interview letters for October or November. Applying 400 online should not cut ahead of people who filed on paper, it should be processed in order it was received, but what can you do? It is not the fault of the 400 on line applicants, it is the fault of the immigration system. Applying 400 while 751 is pending normally does not happen, it is this year huge CSC delay that is causing this mess, but the fact is just the opposite of your concern, applying 400 delays 751, and it seems unfair because people like us have been waiting for a long time, knowing we probably will be delayed for another 7 months is unbearable, but i guess our rewards will be the ultimate 400 approval, so is it fair? It appears to be for people like us, but in the long run, we will be finally adjudicated and it will lead to the citizenship, so I am not sure whether it is even unfair to begin with, it is just how USCIS operates in this bizarre and unprecedentedly delayed CSC year. However, I do agree all applications should be processed in order they were revived, but the delay of CSC this year makes it complicated, it is just no longer black and white or fair or not fair. We just need to keep following up and hang in there until we are all approved. Good luck, I totally understand your concerns about fairness though. Also, I have not seen any documented cases where someone's calling the senator resulting in cutting ahead of other applicants. As a matter of fact, calling a senator is a waste of time and does not expedite the process as well.

I have been waiting for my green card for over a month since I received the approval letter. I called USCIS yesterday and they told me to wait  60 days, before calling them again.  This is just so frustrating. The officer was so rude.
