Contradiction!? How does the CO make up their mind??

1. The petitioner's presence on the consular premises -- for one thing -- enables the CO to ask about any unclear issues that remain after the beneficiary is interviewed.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

We found out, after a bad interview, that the CO only legally has to evaluate your case based on what you sent with the original application. So, if you sent very little evidence with your initial application, it is almost worthless to bring more to the interview because they have already decided based on the application.

Thanks. I guess that means we should send in any additional evidence to the NVC with the AOS/IV package rather than wait to bring to the interview.

AOS send : May 12, 2015, received May 14, 2015 USPS priority

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I sent 100 pics to USCIS and none of them were forwarded to the embassy. CO asked for pictures and he reviewed them on the spot. Luckily we brought some to the interview.

Why do you say that? If the NVC gets the bonafide marriage evidence it'll certainly get sent to the consulate right? Is there a risk it won't?

Never rely on what you have already send, though it does get forwarded, the CO may chose to want to see if you can give him

old and current up to date evidence just because s/he can. Your embassy is not easy, be well prepared.

It is ideal to front load (USCIS), then side load (NVC for CR/IR only) and then again at the interview.

Bring all relationship evidence you have from day one to current.

It's really bizarre how inconsistent they are. People's lives can be majorly upset if they fail the interview because the government randomly decided not to forward the evidence. I guess I'll just bring another copy of the bonafide evidence I already sent in be safe. Honestly this whole process seems like a joke/ below US government standards.

There is also no guarantee, the CO will look at any evidence brought to the interview. It helps that HCMC will allow the petitioner to be present, but that is fairly unique. It is not allowed at the vast majority of Consulates.

What's most important is to have the CO leaning in the right direction, based on what was included in the original petition filing, BECAUSE, they are not required to consider anything else besides the original file, and the required visa application and affidavit of support.

Let me give you a piece of advice I read somewhere or saw on youtube (im drawing a blank right now)

1. Front load, it cant hurt.

2. MAKE 3 COPIES OF EVERYTHING.

copy 1- You submit to the appropriate offices

copy 2- You keep for your records (and bring it with you to the interview)

copy 3- You send to your spouse abroad (or bring it with you when you visit like I did)

This way EVERYONE is on the same page, and EVERYONE has a copy of EVERYTHING.

I had some issues at the interview but it wasn't due to lack of evidence thats for sure (and i didn't even send that much)

NOA1- August 7th 2015 ^_^

Most of us on here are here to HELP each other but bear in mind that there will always be different experiences as each case has its own nuances. Just because I had one issue, doesnt mean you will and vice versa. I breeeezed through some things that others had issues with but then hit a snag where most wouldn't...

I don't know if this has been asked before or not.

If the NVC doesn't send you a checklist telling you that the sponsor or joint sponsor doesn't meet the minimum income requirement to sponsor the intending immigrant, then it is OK right?. So how come the CO is the one that tells you if the income is insufficiant (In some cases)? Isn't NVC supposed to do that? Cause I have seen people who got a checklist regarding the AOS. Or do some people get the checklist and others don't?

No, it is the CO at interview that denies or approves. NVC just does a first "look see" for glaring errors.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
