That is correct. Because now i finally have an opportunity do it, before that i couldn't, i didn't stay illegally because i want to be illegal, obviously. I tried to adjust my status when J1 expired, but i wan't approved (not to GC, i applied for tourist status just to be legal). But it's not the point. Why other people who, like i said, were in even worse situation than mine, had no problems adjusting status through marriage? What could they be checking for a year after the interview? Can't think of anything other than they misplaced our case or something like that. Oh, and our marriage is real, there should be no problem with that either, we lived together for a few year before, traveled together, brought tons of photos... no big age/ethnical difference, my husband is born in US and his family have nothing to do with my country of origin.

If you were here illegally how did you work and pay taxes? If you were working, it would have been illegally, illegal people don't pay taxes. It's difficult for people to have sympathy for someone who lived and worked illegally for 7 years in the US and now you're pissed because our government isn't moving fast enough for you. Our government owes you nothing. You could have just gone home and not stayed illegally, which honestly is what you should have done. But hey, go ahead with that writ. Just be prepared for a denial, obviously it's taking a long time because they are doing back ground checks and since your were here illegally they are having a difficult time verifying everything you've told them. If the background checks are not complete and you force them to make a decision, they decision will be no.

I have SSN since 2008. I worked and payed taxes just like everyone else. Yes, it was illegal for all these years, by my SSN is with me for life. I have no difficulty verifying anything, and illegal work is forgiven for spouses of US citizens. Like i said a few times, i arrived on J1, i had a work permission, but it expired. When i applied for EAD i got it again and i work with same SSN now. And again like i already said, there are thousands of people who arrived on J1 and went thought the same process and did not have to wait as long as me.

You are right - i could not be paying taxes, but i still paid them every year with my SSN!

By the way, i personally know a girl who worked just like me after her J1 expired and did not pay taxes, but three years ago she was approved for GC at the interview. And her husband had two arrests and is 15 years older. How about that? The fact that i paid them only supposed to make me look better, but i am still waiting.

I listed all the places where i worked on my i-485, i also have IRS transcripts from all the years, the year before the interview me and my husband filed joint taxes for example and we submitted it with out application. So yes, i paid taxes, and it's perfectly possible for someone who is illegal as long as they have SSN.

1) Same as them, i tried to stay legally, but i was not approved. Not my fault.

2) I did not get married for GC. Could have done that, by the way, and start legally from the day one - would that be better for you? What else? I actually don't think that i did something wrong. The government was happy taking my tax money, lol. I also never broke the law. I did not chose a birth place and citizenship of my parents, so i don't really understand why are you saying this now. It's too late to think about what happened so many years ago, we cannot go back right, so why discuss it. It's useless. I am trying to adjust my status specifically because i don't want to be illegal, this is the best thing i should be doing now. And the best thing uscis should be doing is their job.

1. Your fault because immigration/government did not approve your stay. You choose to remain illegally in the country.

2. Yes, you overstayed your welcome. Yes, that would qualify as doing something wrong.

2a. You choose to file taxes.

2b. You were left alone by the immigration for 7-years......well, USCIS is now doing their job.

2c. If you are unhappy about USCIS or anyone else, you can choose to leave my country.

Cant really... my husband only speaks english... but we can go become illegals in Australia! Thanks for the advice!
