Hello we have au pair who is on a J1 visa with expiration of 8th September 2016. Her DL is valid through Oct 8th. She submitted change of status from J1 to Visitor on May 2nd. She got a letter from INS asking more information.

First question was to show proof she will leave country prior to Visa expiration date. She plans to get a ticket to Canada is that ok does she have to have a ticket to her home country. Also what date does she have to have this ticket for? Since her application is currently under process will that be six months from when she issued her change of status or Sept 8th date that is stamped on her passport.

Second is to provide proof of supporting herself while she is here. She has her mom who can send her money on a monthly basis. If she sends her 500$ a month will that suffice. She has not her any money to date but will do so going forward.

We also saw submit I-134 form which we can surely do but it states we would need to post a bond or something. What are the implications of that on us incase she does something wrong. Just dont want to submit our names and be responsible for some unforseen activity. We are trying to see options in ways she can get the extension.

My first question, why does she want to stay in the US? It sounds like she is trying to stay permanently and is using the visitors status to try and find a more permanent solution.

Why the ticket? To show that she intends to actually leave the county. Why would she go to Canada?

How long does she want to stay in the U.S? $500 is not a lot per month, I assume you are having her stay with you? You understand she is not able to work AT ALL while as a tourist status...this includes babysitting, cooking, etc.

As I former au pair with other au pairs switching to visitor visas... Do not let her work. A visitor visa is not for work. She can't be with you (or another family) 6 months at the time. You don't want to get in trouble for having someone work for you illegally.

And if she's not going to work then my apologize for assuming so. But like I said as a former au pair with au pair friends switching to visitors visas... I know what that usually means.
