Hi Guys,

NOA2 has been received by my fiancé, and we're waiting on our NVC case number which we need to chase.

A couple of questions:

1. Our NOA2 came a lot quicker than expected. I am flying back out to see her for a month in November, the forms are all on line aren't they so I can do them out there? And I will be able to arrange the medical for when I am back from there?

2. I met her when I was a uni student on a J1 exchange visa. I was at a party and got a Minor in Possession of alcohol so my record isn't perfectly clean. I have sent off for my ACRO which is clear, the only blemish is an alcohol ticket I got when I was 20, back in 2010. I will declare it as want to be as honest as I can be, but will that affect me getting the visa? An MIP is a misdemeanour, and a crime I can never commit again as obviously I'm over the age of 21 now. When I tick the box, will they ask me what happened at the interview? I would be distraught if having a beer six years a go affects my ability to be happy with my fiancé.

Any help would be greatly appreciated!

ignore my last post i figured it out haha!, sorry for being so needy on the forum! last question is, Is the influenza shot that is needed just called influenza, or is it this other name 'haemophilus influenzae type b' ?? thanks everyone again

Just the regular flu shot, you can get it from your GP, boots, tesco or anywhere else that does it :)

2) I am assuming your ticket was whilst you were in the states as I've never heard of it in the U.K? If it's your only offense then you'll be good

Yes the Minor in Possession is what you get in America for underage drinking. I was issued a ticket, went to court and accepted and paid the fine given to me.

So on the DS-160, I will answer 'yes' for have you ever been convicted of a crime, but simply ticking 'yes' isn't an instant refusal for the visa is it?

Once i go to America, i have 90 days to get married. Does this 90 days also include the time that my AOS needs to be filed and accepted?

someone told me that if the AOS hasnt been issued within this time that i will have to leave america?

Yes the Minor in Possession is what you get in America for underage drinking. I was issued a ticket, went to court and accepted and paid the fine given to me.

So on the DS-160, I will answer 'yes' for have you ever been convicted of a crime, but simply ticking 'yes' isn't an instant refusal for the visa is it?

They already know about your American ticket, they knew before they approved the petition. You might get asked about it at medical or interview but I doubt it, London is a pretty relaxed embassy, it will be much simpler than you are imagining :)

I did the same as everyone else, sleepless nights worrying about every little thing, took letters from my consultant to the medical,took a binder full of stuff to the interview - the staff at Knightsbridge were great, the doctor gave my letter the briefest glimpse before telling me it wasn't needed but thanks and the CO at the Embassy asked me a few basic questions (fiance name, how many times have we met) and when I was trying my best to make him look at all my extra evidence just said the magic words 'You're approved'

Just make sure you have the essentials, birth certificate, marriage/divorce/death certificates, affidavit of support and pay stubs, employer letter etc, copy of the DS160 confirmation, visa fee and courier receipt

But mostly take a deep breath and relax, you're on the home straight :)

Nah, youll be fine. Just make sure your fiance knows about it so that you can answer honestly if they ask that.

You just have to be married in the 90 days. It's advisable to file aos asap because you won't be able to work, travel or likely get a driver's license until you do. But you won't be picked up or forced to leave.

I am such a worrier, so any little thing I think may affect me gets snowballed in my mind and escalates my worries. I was reading a walk through of the DS-160 yesterday and when it came to the bottom questions (including the criminal conviction part) it said if you tick yes to any, then is an instant rejection of the visa. It set my worries off no end, but didn't seem right as it stated any conviction, not just serious moral turpitude crimes.

I'll try and relax a little bit more now! I'm out there till early December so will try and get the medical arranged for mid-December and then my fiancé is over in the UK for new years so hopefully can head back to be with her January / February time :)

Cheers, Wooderz. Yeah she knows about it. I'm pretty sure most college kids in America have at least one MIP. You can get one blowing a 0.0 on a breatherliser, simply being in a room with alcohol is sufficient!

Crimes of moral turpitude and serious offenses involving violence, drugs etc, a communicable medical condition or anything that makes you a potential risk are different but a beer as a minor, nope nothing to worry about :)

Get all your documents in order, make sure you've had all your vaccinations before the medical (or pay Knightsbridge for them), enjoy your visit and start planning for your future with your fiancée :)

Yes you have to marry within the 90 days, as Wooderz says you don't have to file AOS in that timeframe but you enter an immigration limbo when you enter on the K1, you won't get deported or anything but you'll have no legal status until you file the AOS, it means you'll find it difficult or impossible to get any kind of state issued identification and of course you can't work or leave the country until EAD/AP is approved so the sooner the better really :)

So I went to the embassy today and got approved! It still doesn't feel real yet (probably because i have not booked my flight yet!)

Anyway.. I was going to ask if the CEAC website will update and tell me anything different now that i have been approved..

After my post yesterday,

I checked my CEAC case number and it now says its under administravite Processing. Is this normal or is there something they need from me?

I was told that i would recieve it within 1-2 weeks at the interview and no sign of a problem so i am confused as to why this is...

Any help would be great!

AP is normal for everyone, don't worry about it. For London give it a couple hours or at least a day or two for it.

Administrative Processing is the status it goes into while the visa is being issued. It's a catch-all term for 'someone is currently looking at your file'.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
