HELLO EVERYONE

im new in this site hope you can help me, it happened the same to me in 2006 in POE airport they cancelled my tourist visa because i was going to the us for 5 months at 2 times in the previous travels but never more than the i-94 (6 months) and i guess they did this for suspecting immigrantion as i read all of you, they stamp in my passport in my visa

cancelled and code

22 CFR 41.122(h)(3)

and the code 212 (a)(7)(i)(i).... but they did not give me a paper or copy form never , only the passports and next day i left to my country

and i dont see the i-175 stamp(what does this mean)

now my parents in 2014 got her resident green card, she applied for me the i-130 for F2b immigrant visa so i have to wait till my priority day comes out in 5 years

my questions are..,o i need a Waiver , will i have problem in the process and the interview at the embassy for the immigrant visa??? do i need to hire a lawyer? and do i need to ask for my situation at por of entry that cancelled my visa?

i have been denied since then student visa 3 times , they only tell me all my family lives there so i have intention to immigrate etc,,, i never did anything illegal and always said the true in the ds-160 when filling it about my family petition in process and all what happened in 2006

so im worried about my immigrant visa in the future and interview for it...... thankss

No, you do not need a waiver because you have no ban.

From the code of your visa revocation, it seems you were allowed to withdraw your application for admission and allowed to depart voluntarily. If they did not remove you, then there is no ban from that. Even if they did remove you (which doesn't seem like the case), it would only be a 5-year 9A ban which has long passed.

Do you remember if they allowed you to withdraw you application? Because if you did... No problems... But if they removed you... Solo I-212 as they did to me... ;)

No. No need to file anything in any case. Even if he was removed (which it doesn't seem like from the code he posted), his 5-year ban would have long passed.

hello guys, thanks for replying, but

why should i quit asking for non inmigrant visa? is it bad for my future inmigrant visa interview???

when i asked a consular in an embassy blog, he told me i can apply for tourist visa and can explain my situation about my future immigrant visa in interview

but it can be hard to get one , i just want to visit my parents before waiting 5 more years without seeing them

its been 10 years since they cancelled it, and waiting 5 more its hard

what are your advices, student visa or tourist visa?

as i said before since 2006 i have been denied 3 times student visa and 1 tourist , the main reason is my family living there and intend to immigrate...

ok thanks, but at interview they never talk about 214b,.... most of the times they talk about my family living there and how they got citizen and residence, and that would be the main reason for me to immigrate as they say

the last interview he asked me about my longest time staying in the us , and he checks the computer and says 12 to 14 months, i dont know how he got that long time or if he added all of the times i went there, becasue the most time i stayed was 5 months,,, so idk if that could be a problem , i guess ill keep trying at least once a year
