I have decided not use a lawyer (its very expensive) and instead fill out form i-751 & collecting the necessary documents needed for evidence of a bona fide marriage.

My concern is the documents I do not have:

  • A lease agreement with both your names on the lease.
  • Utility bills (water, Electric, Internet, Cable), credit card bills, and other types of bills with both names.
  • Mobile Phone bill with both names
  • Medical insurance with both names

The is because we live with my spouses mother (my mother in law) and we have no need for a deed or agreement and the same goes with the utility bills. Regarding the mobile phone bill, we are both under my brother-in-laws grandfather plan which gives us an incredible deal. Lastly the health insurance, we are on separate plans so we can save $400 a month.

Questions

1) How would i communicate the above reasons in the i-751 form ?

2) When showing evidence of joint bank account do i need to print out every monthly statement from the last 2 years ?

Documents I do have:

-Copy of joint federal and state tax returns 2014 & 2015

-401K plan with spouse listed as beneficiary

-Joint Saving and Checking Account 2014, 2015, 2016

-Car Insurance in both names

-Documentation of one vacation, one overseas family celebration, an overdue honeymoon that we have taken, including flight itineraries, hotel bills, pictures of you

together on vacation. Plus pictures taken with family and close friends.

-Travel Insurance in both names

Google "Living Will" on the internet, print out the forms, fill one out in each of your names, and go have these forms notarized at your country clerk's office. You need these eventually anyway.

Copies of your drivers' licenses showing the same address.

You also could get a secured small loan at your bank in both of your names.

Get a joint credit card, showing both of your names.

You can show copies of cards sent to both of you (including the envelopes, showing the dates) at the same address.

Affidavits from friends or co-workers telling how they know you and that yes indeedy, you are a couple and they've known you since XX, 20XX.

We also live with my parents, we got a signed and notarized letter from both of my parents stating where and how long we've been living with them as well as household chores we do to contribute. This should suffice as many young married couples live with their parents to save money before buying their own house so I think it's fairly common.

We also have a Verizon family plan for our cell phones that is operated by my father and includes my parents, me and my husband, and my brother and sis-in-law. If you can print out the monthly cell phone bills, it should have both of your names on the bill. Also a family plan is good evidence that your family trusts your husband.

In terms of medical insurance, I would attach a letter explaining exactly that. Say you wanted to save money, and consider getting a Medical power of attorney for each other.

Do you have drivers licenses showing same address? Copies of credit cards with same #? Mail addressed to both of you? We included some from our friend's wedding invitations that had both of our names on them. Even facebook messages could help

Thank you for the kind and excellent advise. I have some additional questions.

My 2 years expires at the beginning of October, so i have 2 months. Obviously i'm planning to file asap within 1 month just to be safe.

1) Would i have time to get a “Living will”, secured small loan and joint credit card with both our names within a month ?


2) I’m getting Affidavits from sister-in-law and mother-in-law. Would it be advisable to get one from a friend aswell or is Affidavits from family enough ?

Hmm it's strange that there's no names written on the bill, our bill was from Verizon and each month included all 6 of us on the bill. I guess I would try and call the cell phone company and see if they can send you a confirmation that you're both on the same plan and an explanation of why it's not written on the monthly bills? If they can't send you that then just write a letter yourself explaining that. Cell phone bills are not going to be the deciding factor either way so don't panic too much about it

The MPOA is quick, it differs for each state so type into google "medical power of attorney for (your state)". You just print it out, sign it and get it notarized and that will make it official, it shouldn't take more than a day in total so you definitely have time
