My question is this, my sponsor makes way above the poverty guideline but I remember he's had a past DUI. I think he's had 1 and he needed to go to court for it. Should I look for another sponsor? or will the consul accept him despite of the DUI?

Why would the sponsors record matter?

To my knowledge, I have to say it will not effect your petition at all. I believe background checks are done on the petitioner and not the co-sponsor. Remember, background checks are done to see if Petitioner has any criminal records that will deem him danger for you as a fiance. Same goes for fiance and background check with Police clearance as well.

But the answer to your question is the co-sponsor having DUI will not effect your case at all.

A sponsor having a DUI is not a problem. The sponsor's criminal background does not matter.

These are the only things that are considered:

1. Is over age 18; AND

2. Is either a USC or LPR; AND

3. Residing in the US; AND

4. Has income and/or assets meeting the financial requirements of the I-864.
