Hello I was hoping you could answer this question. My mother is Russian and has been a US citizen for 4 years now. She wishes to give me PR/Citizenship via form i-130. However I am over 21 and married, and my wife does not seek to gain USA PR. Do I still need to provide our marriage certificate even if we're not filing for her (albeit putting on the form that we are in fact married) or is only her birth certificate/citizenship copy and my birth certificate all that's needed?

At this point all they need is your birth certificate with your mom's name on it and her proof of citizenship.

Your wife's name will be included in i130 form as your spouse whether she intends to immigrate or not.

I hope you are aware that it would take around 12 years for you to immigrate to US and get the green card. So your wife has 12 years to think whether she want to immigrate to US or not. Only when it comes to interview process (in or after 12 years), you might need to show the marriage certificate if she also wants to immigrate. So don't worry about that for now.

This is going to look very odd to the adjudicator.

You would rather leave your wife behind to live with your mother? Are you planning to stay married?

I can understand your wife not wanting to move. The USA isn't attractive to everyone and she may be perfectly happy with her job, her family and her friends in Russia. But why are you wanting to go without her?

Hello thanks for the replies, wasn't expecting that many that fast! My mother is getting up there in the years, and wishes for me to be able to be able to come and take over her properties in the case of her passing (or if need be myself relocating there) or if there is an emergency and requires my care (my mother does not have any relatives really there). My wife is of Canadian citizenship and is able to visit the USA if need be. It's a quite odd looking situation I must admit myself.

It's possible we will relocate here permanently, but as you said in the 12+ years from now it takes to get a green card it is hard to say what our situation will be (and why she wants to do the paperwork now). I run a business entirely online and relocating would not impact my work.
