Yes, divorce very soon after ROC is suspicious. If you are already thinking about divorce now, you may also have difficulty getting approved for joint ROC. If the marriage is not working out, and you feel you cannot work on it with a counsellor or priest, divorce now, and if you wish to stay in the USA, do ROC with a divorce waiver.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Speaking of real risk, I heard people who get divorced after obtaining 10-year green card are questioned at citizenship stage. Plus if the couple is called to an interview and one doesn't show up, the I-751 will be denied.

My 2 year green card will expire on Jan 27, 2018.

I can start filing for 10 year green card, earliest on Oct 30, 2017 right?

You are pretty close about the date. The earliest you can file is Oct 29, 2017. The GC ROC processing would take anywhere from 7 ~ 12 mo or more (CSC is processing faster than VSC these days).

Divorce right after GC would be definitely suspicious if you intend to apply for early citizenship (3-yr). If you wait for 5-yrs to apply for regular citizenship then there is not much to worry about.

If you are already thinking about divorce (marriage is not working out) why not follow Penguin_ie's advice of filing for ROC with a divorce waiver.

Thank you everyone.

Because my husband is very mean to me :( I came here as a foreigner and had to manage to get a job in which they offered to pick me up and brought me home. I work 6 days per week. I spent my money to hire a teacher to teach me driving and taking me to the test. My husband told me he may not want to be with me or anyone in long-term or having a kid together :( And since I got here, he doesnt take me to anywhere. He said he needs a break from work and from me, he is travelling to Eu and Asia for more than 2 months. I came back to my country and stayed in US house alone for 1.5 months.

Also, we had a preup. I was not with him for his money. He made 450k/year and I made 24k/year but he made me pay for my car insurance, anything I wanna purchase, car repair. Sometimes I wake up in the US thinking why I end up being here without love, friends and family.

I am worried that if I file for ROC now, there will be these issues:

1. He is very economical, so he wont go to marriage counseling. We wont have bill receipt to prove our marriage is good intention from beginning. We only have tax return, insurance, dental bill together.

2. I am new to the country and there are so many things I dont know. He bought the car under his name. I make only 2000$/month. Paying for house, food, insurance etc Im afraid I cant live alone. If Im with him for a while, at least I can learn and save some money before I go.

3. If I have 10 year green card, it will be certain for me to apply for citizenship after 5 years. One year until I can file for 10 year green card is Oct 2017. If I file for ROC now, there is no guarantee my 10 year green card will be approved, so I will have to return home :( What if I meet a new good US guy, I will have to wait for 2-3 years to come back to US and it will be so complicated.

I suggest concentrating on your current relationship and immigration issues before you start thinking about the future US guy you will want to marry.
