SO here is the deal with my case

married feb 27,2004

DCF of I-130 petition with US embassy in CHile was approved mar 17,2004

BUT BUT BUT we travelled around the world for a while so we decided not to go through with the visa process, knowing that extended absences of more than a year result in loss of visa.

SO when we returned, we found that they no longer do the DCF. Write the embassy JAN 13,2007 to ask if old petition is still pending.

NO RESPONSE

Decided to re-petition sending a new I-130, based on a letter recieve while traveling that states ´´ .... as a result, you are hereby notified that your application for visa has been canceled and any petition for you has also be canceled.´´ from Mar 20, 2006

our petition was recieved Feb 7th 2007

and our I-129F was recieved March 6th 2007

BUT we recieved this letter from the embassy via email March 2,2007 in response to the Jan 13th mail.

´´´´As you filed the immigrant visa petition before July 2006, your case is not affected by the Adam Walsh Act. This means that once your husband notifies us that he is ready with all the required documents for final interview, we will be able to schedule his final interview. ´´´´´´

DAMN is this a mind game, or tourture??????

So March 6th, 2007 i go to the embassy to notarize the affidavit of support as specified in the instrustions, and they tell me it no longer needs to be notarized, SURPRISE another change in rules!

That same day i send the PAcket 3 to the embassy via express courier, and still haven{t recieved a responce.

ANY ONE ELSE in the same boat, any advice. ALSO can i get a refund for the $360 dollars i spent on the petitions that i DIDNT know i needed to file.

How long to i have to wait for packet 4 to get an interview date. we are just waiting for this.

THANKS

Shannon

Timeline

No refunds available, but I wouldn't think you'd want to cancel those US petitions just yet. Make sure something is actually happening in Chile.

As for the rest, get used to it :) Things change all the time with CIS. The un-requirement for notarization happens to be a favorable one.

I don't think you'll get an accurate answer on the timeline question--things have been a bit up in the air since January (read back a bit).
