Im wondering how long it would take for my fiance to be able to come back to China to visit after we get married in the USA. Im not sure of the complete process yet. I assume it would be after AOS, just not sure of the timeline for her to be able to go home to visit and then easily return back to the USA

Thanks

Ty

hi

more than 3 months

in the adjustment of status packet the advance parole is included, she can't leave the country without having the travel document in her hands

so your wife will have several months before she can work or travel after you get married. the sooner you send the paperwork, the sooner she will get the advance parole to travel

Hi,

Your wife can file for a EAD/AP card for free when she files for AOS. It takes about 90 days to get the EAD/AP card.

If she leaves the US without AP during AOS, she will be deemed to have abandoned her AOS.

Figure that she will be spending at least 90 days in the US after she files for AOS.

Do not book tickets until her AP comes through. Same rules as when she got her visa. Do not make travel arrangements until you have the proper documents. USCIS will not care that she has a flight in a few days and needs AP expedited.

Best of luck.

I read the prior comments. This is just a personal observation. Because I am paranoid and in the (LE) business, even with the EAD/AP card, we did not travel out of the country till she got her green card. After all this work and effort I would not trust any one on the government side to follow the rules for reentry. Good Luck with what ever you decide to do.

In Arizona its hot hot hot.

The entire purpose of AP is to be able to travel and come back without abandoning AOS.

Many people have traveled with AP with no problem.
