Hello, i really need some help and advice so i got a letter asking for the petitioner to submit a completed federal income tax return submitted to the internal revenue service for the most recent tax year.. i am extremely confused about this as my husband is on a deployment so its hard to reach him and i am still trying to understand the tax in the US.. Do i complete the form 1040? Or would my husband already have completed this form or is it on his tax returns? I sent off his w2 e.c.t with the i864 package but they want this too and its extremely confusing as i just pulled up the form 1040 and have no idea how to fill it out.. any help would be so appreciated

What did you send with the I-864? If you didn't send his tax returns (or tax receipts), then that's what they're asking for. You can get tax receipts from the IRS website mailed to you or as digital files. They'll have wanted tax receipts for the last 3 years (so returns for years 2015, 2014 and 2013).

He probably gets generous tax extensions for being in the military, so he may not have filed his 2015 one. You'll have to ask him.

What did you send with the I-864? If you didn't send his tax returns (or tax receipts), then that's what they're asking for. You can get tax receipts from the IRS website mailed to you or as digital files. They'll have wanted tax receipts for the last 3 years (so returns for years 2015, 2014 and 2013).

Check out the irs website in the post previous to mine, you can get the previous 3 years tax receipt/transcripts for free. It only takes a couple weeks, nothing to worry about. Check it out and if you can't find the right page someone will help with a link. If not I will get you the link tomorrow.

ok ive found it on the tax website however it has copy only do not file in grey letter over it is that okay to send????

Hi i found the 1040 on the h&r block we used but it has a watermark of copy do not file over it is that ok to send?

Yes, you can send that copy with the watermark.

Remember, a complete tax return is the 1040, W-2s 1099s, and every document sent to the IRS. A complete tax return is more than just the 1040.

All it says in the letter is to submit a complete federal income tax return submitted to the internal revenue service for the most recent year then someone wrote next to it 1040 and my husbands name so does that mean i need to sent all the paperwork again? or just the 1040 or the 1040 with w2 forms?

i have attached to the 1040 the w2 for that year too, do i have to include 1099s? i have no idea what that is or where i get it

Some people have 1099s, others do not.

I don't know if your husband received 1099s.

You need to ask your husband what he submitted to the IRS.

As noted, a complete federal tax return is more than just the 1040. A complete tax return is everything that was sent to the IRS with the 1040.

You need a complete tax return, which is all forms, schedules, attachments, W-2s and/or 1099s, or an IRS tax transcript. You can get those online for free. When using the IRS tax transcript, you will not have to worry about whether or not you sent a complete copy of the return or not. The IRS transcript will be all you need.

Providing basic info about where you are in the process can help people answer your concerns better. Fill out your timeline or at least state what process you are in when posting. I am assuming you are adjusting status from a K-1.

I also received an RFE for most recent year tax return

my wife had not yet filed for 2015 so she filed and got the 1040 from her CPA

plus the w2's from employer

and we did the I 864 again and sent documents

The IRS transcript for 2015 would take 2 to 3 weeks to we did not send it yet since we don't have it

Question : in your RFE did they also send to second page mentioning below poverty line point ?

the reason I asked is because my wife is way over and above poverty line however they still sent us that second page with that point

to which my reasoning was that they just send out a format letter

They do. If you get an RFE asking for most recent tax return, then it will always state you did not meet the income requirement. If the taxes are missing or not complete, then you get the RFE with that boilerplate wording.
