Really late with filing AOS

So I know this is not unusual. But as late as us is maybe. I got here on 15 of december, got married on 15 of January. And then how hard we tried we could not get the money for AOS, we have been living off one salary and it's been really really hard and life got in the way.

But now we decided to go drastic and take a loan out for the AOS so I can finally work too. But my question is, will they still forgive us? Is my medical expired allready? And how much would a new one be? And also a side question: I can apply for a work permit at the same time right without the extra fee? So it will just be 1070? Thank you !!

Your medical might be expired. Otherwise there is no difference how late you file. Yes, you can apply for EAD and AP for free. Yes, it's $1070.

And really you aren't that late- someone posted today that they were filing 4 years after entry...

Thanks !! I really read mixed reviews online if it's a year of 6 months. My husband is absolutely sure it's a year because he read it online and on some government sites. But I know u guys are all experienced.

And wow, 4 years?! Allright, we might not be that late then lol.

it does not really matter how long you apply..I just got my green card after being here for 23 years out of status.as long as the marriage is real there is nothing you have to worry about.

If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. If you are missing any shots from your overseas medical a I-693 vaccination transcription is required to be completed by seeing a Civil Surgeon to have certain portions of the I-693 completed and have the Civil Surgeon certify the form (sealing the original in an envelope and giving you a copy).

I would recommend you take a close look at the medical exam documentation. We found that my wife's doctor in China filled everything out correctly EXCEPT they forgot to sign it. It made it through the I-129 process but to be safe she had another exam here in the US.

I was planning on doing that but the medical is in a closed envelope. I read somewhere that I can't open it.
