Hello Experts, I need your valuable advise.

My brother has file my US Sponsership under his name (for his sister), my father is now CITIZEN as well and my father want to transfer the file from my brother`s name to under his name.

Is this possible and if yes what forms I need to fill out and what is the procedure to follow, please guide me.

If I am unable to explain my situation then please ask me and I will be glad to explain again.

nope, he can't transfer, but he can file a separate petition

a person can have more than one petition at the same time on their behalf

if your sister is unmarried, your father should have filed for her as soon as he became a LPR,. In that way the process would have already started

how old is she and what country is she from?

No the file your brother filed will always be under your brother, Your father can file a different case and pay the fees with a new date and which one gets to the front faster will be the one your sister uses to come to the US.

This will not be over quickly. You will not enjoy this.

no, as I said not possible, so he is filing for you not your sister. and you are Canadian as well?

how old are you? Why didn't your dad file for you as soon as he became a LPR?

so your dad can file for you, but it is a different petition, he will have to start with the i130, just like your brother filed for you

I think I am not able to explain the situation here.

My borther is in US, I am his sister here in Canada, and I am Canadian Citizen, I am 38

My brother has file under family class for me and at that time my father was not US CITIZEN.

Now my father is US Citizena and he wants to tranfer the file under his name which is currently under my brother;s name.

I hope this time I have clerly mentioned my situation...thanks

the answer is still the same, your dad can't transfer your brother's petition for you

if you are unmarried. your dad should have filed for you as a resident, and not wait until he became a USC, residents can file for unmarried children, regardless of their age

he files for you and it is a separate petition, with a separate priority date, and the wait from your dad's petition is over 7 years,

a lot less than your brother's petition, which is 13 years of waiting

now if you are married, then the wait is over 10 years old on your dad's petition
