Hi ,

I recently got married 4 months ago and my husband is in Pakistan . We have been planning to apply for his immigration by filing the I-130 petition . but as i have read it takes 2 or more years for the whole process to get completed and then he can come here . But he wants to visits me soon ( in 2 -3 months )as we have been missing each other a lot . Is there any way that he can apply for his Visit visa so that he can come see me only and go back top Pakistan , I can't go to Pakistan since i have no vacations left and i can;t afford to lose my job right now . Please advise if anyone has gone through the same situation ? is it possible to get a visit visa before applying for the immigration ??

It is very difficult (though not impossible) to obtain a tourist visa once they know you are intending to immigrate. It's up to the discretion of the officer and depends on your home country, too, but it is not likely it will be approved.

Actually, it may be difficult to get one before you even file the I-130 since he needs to be honest and say he is visiting you, which may make them deny him, too, since they probably think he will stay in the US and adjust status.

You can definitely try and in some cases it is approved, but it's very rare. He will have to provide very strong home ties to his country, and personally I wouldn't get my hopes up.

You are better starting the I-130 filing ASAP.

For your reference, my husband was denied a tourist visa under the same circumstances - he only wanted to visit me for Christmas. He has/had very strong ties to his home country but that didn't matter... They told him if his wife is a US citizen that he must apply for an immigrant visa.

No its very difficult to get Tourist visa cos my friend did that from Islamabad Embassy he got Refused cos 1-130 Was pending plus Your husband have to wait for Interview in Islamabad so don't waste your times and money on it please I did trying that long time ago and was not working it either
