(asking for my wife) Dear all,

I'm a USC, I'm looking to sponsor my parents and my sister to immigrate to the US. Here's my biggest concern, my sister is currently 20 years old, she will be 21 years old in April of 2017. If I sponsor my parents now, would my sister be able to come with my parents?

Will I need to file a separate application for my sister or would she be included in the same application with my parents?

Hi! Unfortunately, your sister would not be able to come with your parents. You will need to file a separate i-130 for each of them (so that's 3 total). Your parents' cases will take at least 1 year, but your sister's will take at least 10 years. Your best bet would be to petition your parents first, then they can petition for your sister. Assuming she remains unmarried, that will take at least 5 years.

Your sister cannot be a derivative beneficiary of your parents no matter what.

Once your parents enter the US, they can petition your sister. By then she will be over 21, or if she is under 21, she will age out during the 1.5-year wait in the F2A category, so she will be in the F2B category, with a wait of around 6.5 years. And she cannot marry during this time.

You sister can not join your parents when they immigrate.

13+ years if you petition your sister.

7+ years if your parents petition for her after they become LPRs.

Either way it will be about 10 years or more before she arrives.
