DS-260 Question about previously refused visa

My wife is petitioning her mother. We've already completed i-130, and are now completing ds-260.

There is a question in the 'Previous US Travel Information' section asking if she had ever been refused a US visa. She applied for a tourist visa about 4 years ago while my wife wasn't working and hadn't become a citizen yet, and was denied. My question is, should we bother answering yes to this question and explaining? It seems like it could unnecessarily complicate things.

Of course you must answer yes and explain!!!

Lying to the government is the ONE thing that will absolutely get you in trouble! And answering No just because you think it would somehow "complicate" things will surely backfire in your face. Can you imagine the embarrassment and disbelief and horror mom would feel at the Consulate interview when they tell her - "You said no in this question, but what about that tourist visa that we have in our system here from four years ago... Sorry, you were untruthful, trying to hide a fact that we actually already have information about. Visa denied. Next!"

OK, rant over... Phew!

For real, I believe it won`t go so far as what I wrote up there... I believe what might happen possibly is that the NVC will send you a checklist, asking you to fill out that question correctly on the online form. BUT I don`t know from experience though, so best to be careful.

There is no reason to not disclose the denied visa. It is not shameful, and is NOT grounds for application denial. It is simply a denied tourist visa, like so many thousands of people have had. Just write a few words underneath about the date of denial and on what grounds and that`s it. Thankfully, they will have no reason to deny the IR-5 visa, if you stick to the truth and are able to prove you can financially provide for mom. GOOD LUCK!

2016-01-22: I-130 Sent :thumbs:

2016-01-27: I-130 NOA1 :clock:

2016-06-01: I-130 NOA2 :dancing:

2016-06-10: USCIS mailed case to NVC

2016-06-16: NVC received case

2016-06-29: Case Number assigned :dancing:

2016-06-30: DS-261 filled out

2016-06-30: AOS fee paid

2016-07-01: IV and AOS package mailed

2016-07-05: IV and AOS package received by NVC

2016-07-08: IV fee paid; DS-261 reviewed

2016-07-13: DS-260 filled out

2016-08-03: Case Complete :dancing:

2016-08-04: Interview Date scheduled: Sep, 21

2016-09-01: Medical Completed - NO vaccines!!! :no: So happy!

2016-09-21: Interview - APPROVED!!! :dancing: :dancing: :dancing:

Well, I don't know if I made a mistake but, I was refused a tourist visa and in that question I answered not... The questions says:

Have you ever been refused a U.S. Visa, been refused admission to the United States, or withdrawn your application for admission at the port of entry?

I understand that is asking for the port of entry....

I know this is difficult, but I will keep trying. It will work because, this distance is nothing compared to our love. :wub:

10/2013 we met at church in USA, through some common friends. We became friends.

06/07/2014 we went to our first date. :dancing: Why did we take so long to go out? :ranting:

06/22/2014 I said YES.. I want to be your girlfriend... :luv:

07/16/2014 I had to come back to Colombia because my program was over :cry:

10/10/2014 My love met me in Colombia to spend my birthday weekend with me. We got engaged (L)

02/17/2015 - 03/09/2015 He came back to Colombia to visit me and met my family. :star:

05/12/2015 We couldn't stand the distance, so he decided to move here with me. :wub:

05/28/2015 We got married at the notary. 06/06/2015 We got married at church :D

12/03/2016  Moved back to the USA. 🥰

08/2020 Became a Citizen. 🇱🇷

 

08/2020 Applied to bring my mom. ❤️

02/28/2022 went to pick my mom to the airport in Florida 🤩

You should bother to answer yes since it's the truth and the US Embassy has this information.

It would unnecessarily complicate things when you choose to lie under penalties of perjury.

You made a mistake. Commas and the or means separate things. You can not be refused a US Visa at a POE. Visas are not issued at POE. You should have answered yes because you were refused a US visa to visit.

I have the same issue.

Im now filling out the ds-260 form and had a denied tourist visa 6 years ago.

What did you answer? What did you write in the explanation?

Did you got approved?

You do not have an issue. The answer is "Yes" because you have been denied a tourist visa.
