AOS Supporting Docs

I looked at the AOS Guide but didn't see information on this.

Are there documents that need to be sent in when applying for AOS other than the gov't forms? I see people reference leases, insurance, etc. Or is that for the AOS interview?

What things should be compiled and presented?

You will need the following:

1. Payment(s) as required by USCIS. Be sure to include the payment for both the I-485 and the the fingerprinting fee*. Use a money order so you can track the payment. If a personal check is allowed, use that instead.

2. Cover Letter. Should include a description of what your are petitioning for (I-485), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

3. Form I-485: Petition for Alien Relative

4. Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps).

4a. Copy of the non US Citizen Spouses K-1 or K-3 Visa from Passport

5. K-1 Visa Holders: Submit Copy of NOA2 "Approval" for I-129F

K-3 Visa Holders: Submit Copy of NOA2 "Approval" for I-130

6. Copy of the non US Citizen Spouses valid I-94 (front and back copies)

7. A copy of the intending immigrant's birth certificate along with English translation. (If in any language other than English)

8. A certified copy of your marriage certificate. (If filing for your spouse)

9. A copy of the petitioner's and/or intending immigrant's divorce documents. (If filing for a spouse, and one or both of you have been divorced before)

10. A copy of a prior spouse's death certificate. (If filing for a spouse, and one or both have you were married before, and the prior spouse died)

11. Two passport-type photos (see specification) of the Non US Citizen Spouse. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

12. G-325A (all four pages) filled out,signed and dated

13. I-693, Medical Examination of Aliens Seeking Adjustment of Status. (If you already have this from your overseas Visa Interview submit a copy that medical check form; No fee is required in this case. If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)

14. I-864, Affidavit of Support (see poverty limits here)

>> Include any additional required supporting documentation

15. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

>> Include any additional required supporting documentation or photos as well as payment as noted here.

16 I-131, Application for Travel Document, if you need to travel outside the United States while your application is processed (optional)

>> Include any additional required supporting documentation or photos as well as payment as noted here.

* Fingerprint fee not needed for applicants under 14

Everything else that you see mention like leases, joint bank accounts, etc....are for the interview.

Yes, that was part of the guide. I'm sorry, what I meant was, what kinds of things establish proof of the relationship and when is that needed? As I said, I see people reference leases, insurance, credit cards, utilities in the fiance's name, that sort of thing. I want to know what things I must do once he is here to establish our relationship. I saw someone mention pictures of the wedding, etc. That's what I mean.

The AOS application does nto require proof of the relationship. Once you have the interview to be approved (or maybe to remove conditions for the full 10 yr green card) you need to bring evidence that yours is a legitimate marriage. Evidence of this includes financial documents you both share (bank accounts, insurance accounts, utilities etc), photos of the wedding, you as a couple etc.

You and your spouse will need to bring supporting evidence of the relationship... i.e. photos, joint checking account, joint lease, joint mortgage, and birth certificates of children if any etc. Also, it is very important to bring the current passport of the applicant, as the CIS will stamp his/her passport with the I-551 stamp if they are approved.

Does the U.S. citizen have to submit proof of his citizenship in the AOS packet? Like a copy of his/her birth certificate and/or passport? I've seen some people list this in their cover sheet, but I don't see it in any of the guides or instructions.

That will depend on the circumstances of your particular married life. There are some things that are common to most married couples, such as evidence that they reside together in the same home, but what each couple presents as evidence that they have a bona fide marriage can vary widely. Each couple must look at what they have to offer and chose from that what things they will present.

Present your evidence at your adjustment interview.

TYPES OF DOCUMENTS NEEDED TO PROVE COMMON RESIDENCE

(The most important requirement of common residnce proof is that both names of husband and wife must be on these documents listed below, i.e. "joint accounts")

1. Home Contract copy; Rental copy; lease copy; or affidavit from person you are living with which explains the living arrangements.

2. Copies of utility bills; gas; light; electric; phone; cable; satellite

3. Joint bank accounts (must be in both names)

4. Credit/Debit Cards (under both names)

5. Insurances:

a. Auto Insurance

b. Life Insurance - submit copy of policy showing beneficiaries

c. Medical - submit copy of medical cards for each person

6. Photos;

a. When you were dating/courtship period (3 each)

b. Marriage photos (3 each)

c. Birthdays, anniversaries; Christmas; holidays; family gatherings, vacation trips; etc...... (3 each)

7. Babies - Bring copies of birth certificates

8. Major Purchases: New Car; Television; Refrigerator; stove; household appliances, etc.

9. Driver's License (both must have same address to be any good).

10. Military Identification

11. Submit a one page letter describing how you met; how long you dated; or how long your lived together before getting married.

(Note: Ensure you bring copies of these documents; not originals)

I've taken all of this info from the AOS pinup at the top of the forum.....there's lots of great info in there it might be good to check it out.

Thank you all for your replies. Savanphil, I did check out the pinned thread, I must have missed that part. I thought I had read it, but I was probably thinking of one of the pinned threads in one of the other forums. Yodrak, that makes sense and I guess I should stop panicking. I just want to be prepared.

Yes, but as the OP is a K-1, they don't have to file I-130.

Actually, I wasn't referring to the I-130. I was referring to the I-485, Adjust. of Status. Does the U.S. Citizen have to provide proof of his/her citizenship when their fiancee sends in the AOS packet. My fiancee came on a K-1.

They may issue an I-551 stamp; or they may not, it varies. It is an excellent idea to request one though.
