I-864 Joint sponsor recently divorced filed jointly.

I am using my father as a joint sponsor for my wife as I am unemployed. He owns his own business and works for a separate company as well. He recently divorced my mother and remarried. He filed taxes jointly with my mother for the last 3 years.

Question 1: What documents does he need to submit? Tax transcripts or 1099s, and what evidence? He is not required to have a business license for what he does.

Question 2: Since he filed jointly but divorced my mother, will she file a 864A?

Question 3: Will his new wife have to file anything even though she is not dependent on him nor will her income be used?

I am using my father as a joint sponsor for my wife as I am unemployed. He owns his own business and works for a separate company as well. He recently divorced my mother and remarried. He filed taxes jointly with my mother for the last 3 years.

Question 1: What documents does he need to submit? Tax transcripts or 1099s, and what evidence? He is not required to have a business license for what he does. He needs to submit a complete tax return (1040, W2s, 1099s, etc - every document sent to the IRS) or a tax transcript. He needs proof of US citizenship or LPR status.

Question 2: Since he filed jointly but divorced my mother, will she file a 864A? No. She is no longer a part of your dad's household. Her income can not be combined to your dad's income since she is no longer a part of his household.

Question 3: Will his new wife have to file anything even though she is not dependent on him nor will her income be used? No. She does not have to file an I-864a if she does not want to.

So the tax transcripts from the last 3 years can stand alone without the 1099s in this case?

Does he need a employment letter from the company he works for?

As far as his business goes, just transcripts and a US birth certificate is sufficient?

Also since my father remarried will the new wife be counted in the household size? She is not dependent on my father and does not live with him I'm fairly certain. So the only people in my house will be me, my wife, and father.

I greatly appreciate the help as it is really confusing at times to get through the obstacles and figure out exactly how to do things correctly.

As far as his business goes, just transcripts and a US birth certificate is sufficient? Yes. He should be reporting his business income in his tax return

She is not dependent on my father and does not live with him I'm fairly certain. Does not matter. She's counted by virtue of status. Financial dependence and not living together does not matter. So the only people in my house will be me, my wife, and father. No, your household is you and your wife, the intending immigrant. Your father's household will include him, his wife, and the intending immigrant. You are not a part of your father's household.

I greatly appreciate the help as it is really confusing at times to get through the obstacles and figure out exactly how to do things correctly.

Thanks a lot for the help! I have not gotten to the NVC stage yet but I'm just preparing myself for what we need to send in. Do you know if he has to mail in his I-864 separately or do we send it ttogethe? Right now, I am residing temporarily abroad until we both can come back together.
