I-134 affidavit support K1

HI

This is going to sound stupid but after my medical and forgetting my child ID im not taking any more chances.- yes i have to go all way down to london again for their medical. On the plus side i got the extra page saying i have full vaccinations required

Ive obviously done the whole process and was granted visa to have it expire and put on hold, and only now allowed to proceed.

Embassy told me new medical, police report, set up interview- but no charge for visa this time- see not a money making exercise for them.

Question is do I need a new I134 affidavit of support and if so do i get my fiance to send me original or will scanned copies do, Im confused as it says to file it- but where?

then when i was looking on the forum im getting old replies and im worried these arent current anymore.

Or will my old one do as i thought it says it valid for 5 years or maybe i was reading something else.

i know i did it all perfect last year but now with all court stuff legal stuff im getting confused.

any help would be appreciated

It's best that you have an updated i134, also with updated supporting documents (2015 tax transcripts, recent pay checks, etc). The form, as far as I know, should be originals and handed to the officer at the day of your interview.

It should not be older than a year. If the income and information is the same and it's not too old, it should be fine. If you are using a tax return (not required) then 2015 would be better than 2014. It can be scanned and emailed to you. So what proofs do you have and how old are they?

Hi Nich-Nick,

My fiance is self employed and when i first applied it was end of December so we used form 1040 individual tax return for 2013, plus company's profit or loss form, we also had his etrade current statement, and some bank statements showing monthly summaries for in and outs, and a letter from my fiance explaining his normally yearly income as he had problems getting detailed statements from his bank.

2014 was a good year- business wise but think 2015 wasnt such a good year for him, and this year is starting to get busier now.

Glad to know he can scann them into our dropbox and i can print them out here to take down- now that you mentioned it I think thats what we did 18 months ago.

I remember when i went for interview in feb 2105 the lady at first window just laughed at the amount of paperwork i had for my affidavit( felt maybe i had to much- but just wanted to be safe)

A self-employed person really needs a tax return because they have income, but also the opportunity to deduct the costs and expenses of doing business. The profit/loss from business is on Schedule C of the tax return, so no matter how much he gets paid, his business deductions have to be figured in. That isn't really determined until a tax return is filed. So for a self-employed person, the form 1040, Line 22 "Total Income" is where to look to see if he makes enough. If 2013 tax return is all you have turned in, then a copy of 2015 is best and would be the only thing needed as evidence for a London I-134.

His employer could pay $25,000 but that means nothing as self employed because he could be taking business deductions off his tax return worth $10k leaving only $15,000 in actual income that counts for this. Self-employed are a bit limited in showing their income except by tax return.

I think to be covered for your interview as super prepared, you should take--

1) New I-134 because his income amount changed since 2013 tax return proof

2) 2015 tax return or transcript

3) New letter of intent from him because your petition expired.

Hes away to do another I-134 and will scan through to my dropbox along with new 2015 tax return.

Ive got the new letter of intent he posted that to me last month.

Ive also got my court judgement papers and letters/emails between embassy and self in regards to my case being on hold.

So i think ill have everything covered now.

I just keep looking to see if i can reschedule for closer date,
