hi - i came into the US on a k3 visa in january. i applied for EAD immiedately but not AOS. we got a notice this week saying my I-130 has been approved. now i'm confused!

do i now apply for AOS? or does I-130 being approved mean i get called back to the london consulate for processing?

i guess, i'm basically asking, what's the next step in terms of the most common sense/ less expensive route to becoming a permanent resident? thanks!

Less expensive would be to do AOS in the states (You don't have to pay for Airfare to fly to London), Depending on where you live AOS may take longer due to the work-load at your local CIS office.

Either way the fees add up to be about the same.

If you follow the I-130 then you will fly back to your beneficiaries country and go to another interview at the US embassy. The good news is that if you do this they will issue the green card immediately and you don't have to wait the months or years for AOS here in the US.

You need an approved I-130 to AOS. The K-3 a visa to allow families to be reunited while waiting for approval of the I-130. There have been innuendos and suggestions that you can apply for AOS without an approved I-130; however, I don't personally know of any K-3's who sucessfully adjusted without and approved I-130.

There aren't any K3s who adjusted without an approved I-130. The I-130 does need to be approved before the I-485 can be approved.

But there are many K3s who applied to adjust without an approved I-130 and who successfully adjusted. Because the I-130 will be approved before the I-485 is approved. (Or both will be denied.)

It appears that you still do not recognize the difference between submitting the application and getting a decision on the application?
