Tourist Visa to the US

Timeline

I want to know if anyone has attempted to get a tourist visa for their fiancee/spouse to visit while they were waiting for an interview? My husband is currently waiting for scheduling and it looks like it could be 4 more months before he's actually scheduled in Lagos. :help: please

It probably won't be easy to get at all considering that you have already applied and are in the system for the I-129F - which has immigrant intent. Tourist visas do not so you would have to try and prove that you don't have intent when applying for a tourist visa (if you are even allowed to apply at all - someone else should be around to give you this answer).

Filing I-129F doesn't show immigration intent in the way you think. After all immigration intent is all about not leaving when you visit. You generally can enter the USA on a visitor visa while I-129F is processing, as long as you plan to leave the USA on that vistor's visa, and not remain and file AOS. Just because you intend to immigrate to the USA at some point in the future, doesn't mean that on any trip to the USA before that date you have immigration intent.

That said, West Africa is a high fraud part of the world, so visas will be highly scrutinised.

There is an approved I-130 and an immigrant visa application that appears to have completed pre-processing at the NVC and may now be at the consulate.

12/12/06.... Biometrics done (Day 29)

01/20/07...Interview notice received dated Jan. 12, Yay!! (Day 68)

01/30/07....EAD touched, finally!(Day 78)

02/01/07....I-485, I-130 touched. EAD card production ordered (Day 80)

02/07/07....EAD card received in mail (Day 86)

02/26/07...Interview - name check pending (Day 105)

06/21/07.... Card production ordered email...omigosh! (Day 220)

06/24/07.....Email: Notice mailed welcoming new permanent resident on 6/22

06/30/07.....Welcome notice received in snail mail

07/02/07....Email: Approval notice sent. GC received in mail!!! (232 days from filing)

Where did you get this info from???? Hogwash! Tourist VISA have absolutely NO impact on your applications nor do they effect your tourist visa application when you have an existing application in for immigrating. This information is keeping families apart. There are many stories on here, including my own where my wife, while waiting for her Immigrant interview, recieve a 5 year B-2 Tourist visa. APPLY!!!!!!! Your chances are high you will get it as long as you tell the truth, dont hide anything, and express it would be foolish for you to overstay your tourist visa while waiting for your immigration visa. First it is illegal, and you can be deported and banned from reentry in the US for 10 years, and it would be foolish to jeopardize this when so close to getting your immigrant visa. Second, just have the required information they ask for, pay the $100 application fee and go for it. Yes there are officers who are tough, but MOST donot want to keep families apart.

11/10/06 - Married in Ukraine

11/14/06 - I-130 Petition filed and approved

12/08/06 - First interview - we cancelled - shot ourselves in the foot for this!!!!

01/23/07 - 2nd Interview was cancelled due to Adam Walsh Act

02/13/07 - Sonya recieved her 5 year B-2 Tourist Visa

02/21/07 - Sonya arrives in America

02/26/07 - We are told of new interview on 3/8, but she is in america

03/08/07 - Cancelled interview, Sonya is in America

04/16/07 - Fly back to Ukraine

04/25/07 - FINALLY!!!! LOL Interview and VISA approved!!!

04/27/07 - VISA delay due to Sonya's name misspelling - Embassy typo in database

05/02/07 - Called DOS Washington - name check cleared for Sonya - but

told us no VISA was approved for daughter

05/03/07 - Embassy says VISA printed 5/2, but we caught that they forgot VISA for daughter

and the courier entered wrong address to mail VISA - SO MANY TYPO's & MISTAKES :(

05/08/07 - VISA YEAH!!!! FINALLY!

05/23/07 - Back to America - Well almost - Airlines messed up and sent daughters ticket to Chicago

05/30/07 - They finally made it!!! :)

07/03/07 - Green cards recieved

07/06/07 - Applied for SS card at local office, DS-230 application lost

2/19/2010 - Everything is great!!! We now live in South Carolina - Sonya has applied for her citizenship!! She attends USC for her BSN. Her mother has made 3 trips to US.

Thanks for the information everyone. I just want to clear it up that I did not apply for I-129f, but have an approved and completed I-130 like Yodrak noticed. My husband is awaiting interview scheduling in Nigeria. And yes I know Nigeria is notorious for fraud, and it's very hard for them to get tourist visas. I did email the embassy to see what information they could give me. I just wanted to see if anyone here at VJ had any similar experiences that I could take into consideration. I think I'm going to advise him to apply. I only have $100 dollars to lose if they don't approve him.

HI, Im married to an LPR and haven't received I-130 approval. I want to here your story about filling Tourist Visa for your Spouse. It so hard to wait for so many years before I can go to USA. I am from Philippines. As I read your reply you give us hope that WE can also file for Tourist Visa.. Anyway, how long did your wife stay in the USA under TOurist Visa? 5 years?!!! .. some people say that people have pending petition CANNOT apply for Tourist Visa because Immigration thinks that they'll never go back to their home country..

Stating fact is not an insult.

The fact is that Nigeria is a high fraud country for US immigration, Phillipines is another (in fact, those are the top two last time I looked).

Nigerians on here have no reason to be insulted by what I said. I never inferred anyone from Nigeria on here was committing fraud, I just said that because Nigeria is a high fraud country, anyone going through the Visa process from Nigeria can expect to be scrutised due to the unethical actions of some of their countrymen.

A well respected Immigration Lawyer who frequents another board said a long time ago that the world is divided into 4 Categories as far as Visa Fraud is concerned.

Nigeria was No 4, in its own category.

Philippines would be in Number 3 with quite a few other countries.
