Hey everbody... we are almost done with out K-1 Process and I was curious to know if anybody would like to share if we need to submit any proof of relationship or marriage when we file for AOS. I mean yes of course the Marriage Certificate but is there anything else needed? I will be arriving in the US in November and we plan to get married pretty soon after that so we won't have a lot of proof at that point. Any suggestions?

I don't know if you will need so much evidence for AOS beside your marriage certificate, wedding pictures for now, name change.

What you should start thinking about from now is documenting everything else, for the real big one which is Removal of Conditions I-751 in two years after you receive your temporary green card. That is when you need to have as much evidence as possible, including,bank joint accounts, real estate or rental agreement, joint tax filing, joint credit card accounts, insurance, pictures of you both with family members, vacations together and the list goes on...its all up on you to provide as much evidence and there is no such as too much...

Okay, I was worried because since we filed the K-1 we haven't seen each other and we wont see each other till November so we don't have any new pictures or such. But Wedding pictures and the certificate should not be a problem at all. The name change I will still have to figure out how to go about that and where to request the change of my passport Name and all other documents.

Yes the ROC will be a big deal LOL I'm already thinking about all these next steps and making myself a little crazy over it. But I'm sure it will go smooth in the end.

What I mean by name change is in the social security, employment card, drivers license or ID's etc... good luck!

When you file for AOS after entering on a K-1 you only need the marriage certificate, provided you are applying soon after the wedding. No other proof of marriage evidence is needed for the AOS. You don't need to include photos of the marriage. A name change is optional, and it is also unnecessary to include evidence you have changed your name.

As noted above, you should start thinking about gathering evidence for the ROC.

The only requirement as proof of marriage with the initial filing of the I-485 is a copy of the marriage certificate. No photos, other than the passport photos that are required, are needed either. You can include them if you wish though.

If you are changing your name through marriage, then use your new married name on all the AOS forms. The copy of your marriage certificate is the legal name change document. Nothing else is needed to prove you changed your name.

If you cannot easily and quickly change your passport, then I would leave it in maiden name until you receive your green card. You will need the passport for the bio appointment and if you happen to get an interview. You don't want to have sent off your passport and be without it when needing it for the immigration processes.

You apply for the SSN as soon as you enter the US with your K-1. You can change the name on it later, after you get the EAD or green card in married name.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

Quick question what is the ROC? :) And at what point in time would one have to start gathering evidence for it? I just sent my AOS package out. waiting for my to hear from USCIS. Thank you :)

Thank you everybody for the helpful advices. I will start gathering Evidence for our ROC once in the US and will look into these links and all to see how the forms are to be filled out and which documents i still need to gather.
