Begs the question if his home State has jurisdiction, no idea.

Insufficient data to see if they are US Citizens, not a mention of a CRBA.

The question is even if the father has 5 years' physical reserve in the US, will he cooperate with getting the children CRBAs? His cooperation is needed, is it not?

If the kids don't get CRBAs, does that mean the mother can't sue for child support? They're still his kids from his marriage regardless of their citizenship, right?

The question is even if the father has 5 years' physical reserve in the US, will he cooperate with getting the children CRBAs? His cooperation is needed, is it not? In family court, OP can get the court to order the father to file for the CRBAs.

If the kids don't get CRBAs, does that mean the mother can't sue for child support? No. She can sue based on him being the dad. Lacking CRBAs does not mean he is not the dad. They're still his kids from his marriage regardless of their citizenship, right? Yes, they are his kids regardless of anyone's citizenship. In some states, the husband is presumed to be the father.

For a little more clarification, and to help myself understand more. I took the question to Avvo.

Texas based Family Law Attorneys stated that if she wishes to pursue legal action she is required to appear in court. So I don't know how many options are available to her if she wants to/needs to sue for support.

I dont think your husband has any intention to help you out, seems like he was verwhelemed with taking care of his first 2 kids and then you having twins, he has tricked you and he no longer feels he is your responsability because you are out of the country. I doubt you will get any child support, he can state you left the country by your own with no warning. Seems like your major concern is if your kids will have US citizenship which sounds something you were looking for too.

You stated that she currently reside in Texas. That's not true. That's a game changer since she is considered a resident of Texas.

How about you ask if a petitioner needs to make a personal appearance or can phone it in. Include that she is not a resident of Texas, and reside in Bangladesh.

Attorneys can make appearances for their clients.

If he doesn't pay, it's easy to make his life miserable. In my state, he goes to jail for criminal non-support (basically a contempt order). The children need to be recognized as U.S. citizens.

He could also lose his passport, correct? No more playing Romeo, abroad.

New question has been posted, I'll let you know the responses, I am genuinely interested to expand my understanding of the situation. As I did not fully understand the information on the US HHS website.

A person can lose his US passport for failing to pay court ordered child support.

Correct, your US passport is forfeited once you become $2500 or greater in arrears (personal experience). The $2500 is the federal level required before states can submit the documentation to revoke your passport. It is not an automatic revocation, the request to revoke must be submitted by the HHS department that you owe the money to.

You keep arguing this point and you are 100% incorrect. An attorney can appear in court for a client, it is done every day, in every state-all over the country.
