Husbands last name or mine

USC by birth and I'm wondering when doing I-130 form do I use by last name or his ?? I'm aboard so I haven't changed my passport or ID or anything else yet. This is my first marriage and I just been getting confused about everything (between baby brain and extreme heat I can't think straight) no nasty comments please

Jennifer, if your intention is to keep your maiden name then list that. If your intention is to change to your married name then list that. If you want to be absolutely sure of no confusion (in the case you are using your married name) you can write a sentence in your cover letter stating that you will be changing your name to your married name.

hi

it's up to you, what do you want? do you want your GC to have your married name or maiden name?

that's how you'll fill out the form

Since I am the USC I will NOT need a GC

I did state that I know I did

Of course I'll take his last name I don't not have the ID changed to it yet

As soon as I return home with my husband I plan on taking his last name but I can't do anything now since I'm aboard to legally change it on my passport or my state ID or even ss #

Hello sultana I find the I-130 confusing I do not want to keep my maiden name as all my plan was to keep my middle name the same since my husband has 2 last names. I have the marriage certificate I just wasn't sure if my passport had to say my married name or if I could just use the marriage certificate to show that I am married.

Yes that's part of what the marriage certificate does, allows you to change your name. Even if your ID etc does not yet reflect that name change.

you are very welcome i am glade to help out :) my husband is from algeria and i am from the USA and when you fill the forms out make sure you have your info and his info and then you will pay $420.00 dollers and then they will send you by email ,text,and by mail a paper that have his receipt number and it will say form I-797C, Notice of action that mean they are sending it to NVC and that is a good thing and once they get it call them everyday for the new case number and invoice number there number is 1 603 334 0700 and USCIS number is 1 800 375 5283 and after you they give you those numbers he needs a sponor i am telling you this cause i been in your shoes i didnt know anything about it but i called them and they help me to understand it and plus i had a hard time finding a sponor for my husband and i thank ALLAH for my mother she is willing to be his sponor so if you have anymore questions you text me anytime :)

I'm actually going to be filing the papers while I'm still in dr I have my tax returns from last year to show my income I had my own buisness. The form was so confusing for me I thought you had to legally change your name through court before you could be able to use it especially when filing forms like the I-130 but hey you learn something new everyday. I love this site too I found a lot of nice helpful people but also some bad apples as well thank you for your help hun

You did legally change it already. The pure action of getting married is what allows you to just start using the new last name. There is no formal process. You literally just start writing your name differently.

When using it on legal forms and your ID does not match what you wrote, that is where you present the Marriage certificate as proof you are allowed to write a different name.

There is no other complexity to it. if you are married write the name you want to use, and furnish the marriage cert as proof.

Um Actually No. I am a US citizen, and here is exactly how it worked. I married my Wife, She took her marriage certificate with passport to the SSN office, She wrote down my last name on the papers. They gave her all of her documents with My last name.

In the USA Marriage is an available option for legal name change. Ask any judge, or lawyer they will tell you the same, you do not need a court ordered name change when you get married.

I am a USA citizen as well. She was married in dr not USA that's why she must legally change in name in USA first your wife is a noncitizen married in America that's why it was so easy for you and her. It's not as easy for someone living abroad married in a different country my friend went threw the same thing if she can't change her id or legally change her name is the USA she can't use her husband last name until she does that. Every case is different and is not as easy as what you went through. Understand??
