15 Year Old Child Custody

Timeline

My fiancé has a 15 year old daughter.

We are still working on it, but it doesn't appear the father will sign papers to let her come to the US.

While there is evidence of the Divorce, the papers does not address child custody.

The father does not provide support, nor see the child, but he does maintain occasional phone contact.

What are our options?

Is there a way to get full custody of the child by the mother?

I have no idea what to do.

Sorry to hear.

The problem is that in many countries even if he does not pay child support or have some form of custody, he has a legal parental right to prevent his child from leaving the country without his consent.

You best option is to find a good lawyer. Your immigration journey for your child will need to be put on hold until this is sorted out.

When does she turn 16? My fiance had a daughter who was 16 at the time of their interview and there was no need for any signed papers allowing the daughter to leave the country. Good thing for us as the father was an SOB and would never have signed them just to make our life difficult.

Talk to him and try to convince him that he can still call his daughter or even skype. And you don't need money from him or anything, you just want a better life for her. If it doe 't help - hire a lawyer, show that he did nothing to support his daughter. In Russia law is always on mother's side. The last resort is paying him. When my cousin's mother, my aunt, died and he was left alone, my parents tried to get a full custody but his father, who was missing for 15 years, stepped in and asked for money. My parents just tried to bring him to our city, a capital, to give him better education and life. And his father wanted to make money. He changed his mind in the end when judge told him to get a full custody and raise his own son. He agreed to be paid a lot less and signed the papers.
