Friends of mine have received an RFE after filing their I-751. The RFE form is requesting copies of their bank account statements, but the ex-spouse's name is still listed on their main checking account -- and the ex-spouse's name cannot be removed, as the ex-spouse's name is the first name on the account. How should they explain this to USCIS? Thanks in advance for any suggestions.

Hello,

it cannot be removed because the ex-spouse need to be present ?

It is a bit suspicious on their side to see the ex spouse is still on the account, requesting a RFE is actually a good thing so it gives them a chance to explain.

The best is to say the truth, sending a letter with explanation.

So they did not have a joint account ? or the three of them are on it ?

08/08/2016 - Biometrics walk-in successful

08/17/2016 - Scheduled appointment for biometrics

07/10/2017 - Approval Letter received dated 07/06/2017

07/20/2017 - Green card in the mail

03/28/2018 - Divorce granted
CITIZENSHIP

07/17/2019 - Sent N400 Online -  5 years residency rule

07/23/2019 - Received NOA for biometrics

08/05/2019 - Biometrics appointment 

09/30/2020 - Interview - Approved

01/13/2021 - Oath Ceremony

01/13/2021 - Applied for passport at USPS

02/02/2021 - Status "In Process" 

02/18/2021 - Passport Received

Why is the ex-spouse on the account?

They should use their cover letter to explain. We received an RFE and explained various things in our cover letter. Then we were approved. Of course, we also sent in a lot more documents than we initially had.
