Mailing I-129F without the I-797?

Hi,

I have mailed our I-130 on March 1st, 2007, they had cashed the check a week later, and I still haven't received the NOA1. I have called the service center, however, and they gave me the receipt number. Can I just send the I-129F with the receipt number noted on the cover page as proof that I-130 is in process? Or do I need to wait for the I-797 (they said they will resend it to me again). Time is of essence!!!

I was in the same situation. I sent my I-130 on Feb 11, which was received by CSC on Feb 13 (Filing date Feb 14) and the check was cashed on Feb 20. I found my file number on the backside of the cashed check. However, I did not receive my NOA1 for a while. I called USCIS on Feb 28 and Mar 2 and received the NOA1 on Mar 10.

Meanwhile, I sent my I-129F without I-797C on Mar 2.

Together with I-129F documents, I sent a copy of I-130 (without attachments), FedEx airbill, tracking record, online banking record (showing the check is cashed from my check account), copy of the cashed check (also showing my file number) and copy of the USCIS online status check (with my file number). I attached the cover letter with my file number, which also explained those evidences and reason I was sending I-129F without I-797C, and also asked to verify that I surely filed I-130 by putting my file number on USCIS system.

I was not sure whether I could simply send the file number or not. I was even not sure whether the documents I sent would be accepted as evidences that I filed I-130.

I-129F was received on Mar 5, check cashed on Mar 15 and NOA received on Mar 16!

I have not received an instruction to submit I-797C of I-130 (but probably I am going to send it)

It may not be necessary to send many documents like me, but at least it was successfully put on the file.

I am in this same situation, My check was cashed on the 20th of this month, i am so stemed and i am sure you guys are that a government agency can not send out something as simple as a recipt that they recieved your application, when they know that it is so important to the processing of your next application and that every thing is time sensitive.

My online account shows that my check has been cashed, but i cannot see the check yet as it sometimes takes up to 3 days for the check image to be viewable, when i call the USCIS center what information do i need to ask if my NOA1 has been sent out, is my name enough or do i need the file number, also in all future conversation with USCIS is the file number the best thing to quote to get inforamation on a particular case,

a lot of people seem to be accesing an account on a website to see the status of their file, which website is this and what information do i need to establish an account?

23rd March 2007, Recieved I-797 NOA1 for I-130 (Had a spelling mistake in Benificiary Last Name).

26th March 2007, Called USCIS about mispelling on I-797; they made a note, gave me a "T" Number, said submit I-129F with current I-797.

19th April 2007, "touched".

13th June 2007, "touched". (Due to Phone Call Enquiry)

Thanks for posting your experience, this is encouraging information.

I suspect that a copy of the form I-130 and the FedEx airbill and tracking record (as evidence that the form was submitted) would have been sufficient documentation to support the explanation for why you did not submit the I-130 Receipt Notice.

Probably you are right.

At that time, I tried to send every documents which shows the process I filed.

I am not sure whether it had been sufficient, but that was what I actually did.

Please note that I am not recommending the way I took.

Although it was received and on file now, there maybe a delay in the review process, etc. That is my risk.

(I was planning to send I-797C after it is transferred to other service center (according to other people's timeline, it is likely to be transferred after it is on file), but the status has not changed since Mar 15. I am planning to send I-797C with my file number, if the status does not change this week. If it is transferred to other service center soon after, I will resend it to that service center.)

It depends on when you called CIS, but in my case, I-797C arrived one week after I requested them to resend. So you may receive it soon. If you can send I-797C, that is the best way.

I still haven't received my NOA1 for the I-130. The first time I called the lady said nothing could be done until 30 days had passed since they said they had sent it out. I waited the 30 days, called them again and then they said it would take another 30 days for me to receive it. It's ridiculous! I wanted to file for a K-3 but didn't want to send the I-129F without the NOA1, didn't want to risk the chance for them to send me an RFE.

Let us know if your petitions are approved without having sent the NOA1 for the I-130. ;)

I have mailed the I-129F today without the I-797, but I have included the Receipt number they gave me over the phone on my cover letter. I've also included a copy of the I-130 I had sent along with a copy of the cashed check.

I hope it will be sufficient! And I am now so sorry I had to wait almost a month to do this!

I see in your timeline that you don't have your NOA1 for your I-130 yet. Wow!! 30 days is too much...
