Im am going through a divorce, but plan on re-marrying as soon as my divorce is final. My girlfried is living in Romania and she was going to come here for 3 months but we decided its easier for me to get there.

The question is do I have to be legally divorced before we can use our meeting in person as a proof of meeting within the last 2 years or does it matter, as long as we've met before and can prove an ongoing relationship?

USCIS isn't the morality police.

You are required to be legally free to marry when you file the I-129F. Not before.

So long as you are legally divorced and can include documentation proving the dissolution of your previous marriage, you're fine.

DHS regulations (8 CFR 214.2(k)(2)) require that the petitioner and the K-1 beneficiary have met in person within two years immediately preceding the filing of the petition. At the director's discretion, this requirement can be waived if it is established that compliance would result in extreme hardship to the petitioner or that compliance would violate strict and long-established customs of the beneficiary's foreign culture.

There is absolutely no wording here that suggests that there is a problem with this. There are several stories like yours on the forums that are very similar to this.

Agree with TimsDaisy USCIS is not the morality police.

When i first meet my fiance he was married but separated and he came to Romania 2 times before he had the divorce paper in hand so don't you worry about this, save everything can help you to get the k1 visa, dont trow away anything how we did :P

Take this time like a test of your love not like a punishment bc you are still married and can't be with the person you love.

Hello. Your case is exactly like ours. Im from Romania, and my fiance is still waiting now for the final papers of divorce so we can apply for K1 visa. It dosent matter that u was not divorced when u guys adted...he was separated..moved out since 2 years and he is just getting his divorce papers.. In no problem because of that.
