Hello, everyone :)

I am a former Peace Corps Volunteer and married an Ecuadorian over two years ago. I am wondering about the affidavit of support form. I do not currently make 20,000 per year ( I make less) because I just started a business. For the past three years I haven't made any money because of my Peace Corps Service. I applied for a job to start in October. So my question is, if we submit the petition in August, by December I will have 2-3 months of income that will make over the poverty line, but I will have to pay stubs for the past three years and my IRS tax forms will show I made no money for the past 3 years.

Do you think this will be a problem? Should I find a sponsor instead?

If you don't make the income requirement you definitely need a sponsor. This is something they do take seriously because they don't want your husband to have to go on food stamps, etc or other gov aid when he arrives in the States. Definitely wouldn't hurt to show info about the amount of money you will be making when you start your new job, etc, but I would definitely find a sponsor.

From my experience, they don't look down on having a sponsor, especially if you show them why this is necessary (you lived in Ecuador, started a business, etc). I have been living in Ecuador for two years with my fiance and thus don't meet the financial requirement either. My dad co-sponsored my fiance and they were totally fine about it at the embassy when we had our interview. I didn't even make enough last year to have to file taxes and they didn't think that was weird / get pushy about why I didn't have a tax return.

I would say though, when you submit make sure you and your sponsor both fill out the i-134 form. I realized at the last minute that they would require one from me (the US citizen petitioner) and my fiance's co-sponsor (my dad).

You can use your pay stubs as evidence of your current income, but I suggest finding a joint sponsor just to be sure.

OP is filing for a CR-1/IR-1 visa, therefore she wouldn't use the i-134 form. She would use the i-864 form once her case is approved by USCIS and is at NVC.
