CEMAR after divorce

My fiancé has a divorce from her former US husband. He filed it in the US and she has her final divorce decree. Naively we both thought as long as we have the decree in hand we are ok to apply for the K1. We have not filed the divorce with any Filipino government agency at this time. I just happened to stumble on something about a CENOMAR which got me worrying that we may have a problem.

My question is this. Will we be able to get the CEMAR showing her divorce simply by going to the NSO with a divorce decree or will we need to file the decree in court first? Any help is much appreciated. We are worried we might have jumped the gun. We are expecting our NOA2 in the next 30 days or so.

You will need to file an acknowledgment of foreign divorce in the Filipino court system. It is a shorter process than an actual annulment, but will likely take 6-12 months to complete. However, from what I've been told as long as you have the US divorce decree in hand you should be good to go for your K1 Visa. However, if you plan on living in the Philippines or buying joint property etc. in the Philippines you must clear your fiancée's CENOMAR. I'm in the same boat and this is what my immigration attorney has advised me.

Base from my experience, I took my divorced decree from my Canadian ex, authenticated at DFA in Manila and then take it to NSO. NSO then stamped my divorce decree as Null and Void and marked it as Divorced. After which I got my Cenomar.

This only applies if you got married in the Philippines.

your fiancee and i have the same situation... we filed for k1 now and we have mnl case number...also my problem is cemar.. which is indicated my name ex on it. i knew someone gave me an advice but still make me a lil worry lol.. hope i wont get any problem in my interviw at the embassy

From what i read in the thread that is linked above it seems others have gotten through the process simply by bringing the divorce decree attached ot the CEMAR to the interview. We received our NOA 2 a week ago so we will find out soon enough. From all indications we should be good to go.

Please let us know what happens and update us on what happens. We are in the same situation. Although we have a US divorce decree we are going through the Philippine legal system to get an acknowledgment of foreign divorce just to be on the safe side. We will also take a letter from the Philippine attorney explaining the case is in process.

i didnt file for recognition of decree of divorce here in pinas .. we just filed k1 without filing my divorce in court to be recognize. thats also what ive read and gathered info. that were good to go for k1 without it.. my interview will be so soon. people who gave advices here said no need for that as long as we have divorce paper to show along cemar.. but theres onething that makes me confused. about annotated one? idk what that is...
