My mom got his immigrant visa interview last month and got a IN-6C1-misrepresentation 212(a)(6)©(i) denial. I am a USC and everything went well until she got to the interview. She was denied an immigrant visa in 1985 due to a marriage that was "determined" to be fraudulent. This came up during her interview this time. Is there a waiver or another resource for this situation? has anybody had to deal with a similar situation?

Thanks in advance for any help provided.

Clearly says a waiver is not available. You didn't think denial from 1985 would come up a the interview and you still filed a petition?

You need an atty call Heather Poole for free phone consult

Lizz Cannon is swamped right now ,did they say on the 221G

she can seek wavier?

Does she have a USC spouse or parent? USC kids can only

waiver parents with waiverable CIMT but nothing else, so

speak to an atty.....Email or call NVC annually to keep the I-130

alive for the future.

Unless she is the spouse or child of a USC or LPR dropping money on legal help won't do anything. There is no path forward until one of those conditions exist AND that person can show hardship

This will not be over quickly. You will not enjoy this.

True.

That's why I suggest she speaks to Ms Poole (its free) & there

are SOME instances a kid can waiver a parent NOT! for overstays

since I am not an atty best to ask one, I don't know if a better answer

would be gained...Heather Pool or Liz Cannon do not take on cases they

know is a dud, they are swamped with clients
