Last Fri. a family member got arrested for a DUI 1st offense and refused to take a breathalyzer. His ROC I-751 has been pending almost a year through VSC, and he also filed for N-400 and did fingerprints already. How will this affect his 2 cases? He's freaking out he'll be deported. I told him to call criminal defense attorneys who also do immigration. He has no other criminal history.

I imagine USCIS will put both cases on hold until the criminal case is done? His I-751 extension letter expires in Aug., which is why he's afraid he'll be deported. Any advice?

If anything, it may affect his N-400 as it requires the applicant to be of good moral character and without any criminal convictions (I don't even know if these apply to DUIs). He should be fine with the ROC. A lot of people have DUIs and still go through the ROC process with no problems.
