Proof of financial support when petitioner is a student

Hi

We're currently going through the K-1 visa process in London where both my US fiancee and I work. However she is moving to Boston in August to start at business school, so will have no income/salary - I intend to write an explanation for the change in finances, and show proof of savings etc that I can support myself and not draw on state financial support.

Has anyone been in this position, where their petitioner is a student? Did it cause any problems with the affidavit of support?

In London (but hardly anywhere else), you can sponsor yourself for the K1 visa, granted that you have sufficient savings.

However, this will not work when you're in the US and applying for AOS after marriage. Then you will need to find another co-sponsor that is willing to support you.

Thanks for your reply - and I'm guessing if that sponsor is a student it might cause issues? Would you know if it would be ok if they're a student so no monthly income, but can demonstrate that they have significant cash and savings?

If you have your own cash and savings (3x the 125% of poverty level) or a joint sponsor has savings (5x), then that is supposed to work in lieu of employment in an I-864 for AOS. It's in the form Instructions.
